【摘要】：拋開(kāi)歐盟政體形式的具體構(gòu)成不論,歐盟的發(fā)展目標(biāo)必然是一種新的社會(huì)共同體,以滿(mǎn)足歐洲人民在傳統(tǒng)的民族國(guó)家框架下所難以實(shí)現(xiàn)的利益。從實(shí)質(zhì)上看,歐盟立憲就是構(gòu)建起歐盟作為一種新的社會(huì)共同體所必須的根本價(jià)值與規(guī)則體系。歐盟立憲的功能主要體現(xiàn)在新的社會(huì)共同體的合法性的確認(rèn)、集體認(rèn)同的塑造、價(jià)值體系的構(gòu)建和制度框架的確立。《里斯本條約》的批準(zhǔn)生效并不意味著歐盟立憲過(guò)程的終結(jié),它只是對(duì)原來(lái)精英推動(dòng)式的《歐盟憲法條約》的一個(gè)更加務(wù)實(shí)的改革方案,在本質(zhì)上,它仍然是實(shí)質(zhì)意義上的歐盟憲法的動(dòng)態(tài)生成過(guò)程中的一個(gè)階段性成果。
[Abstract]:Regardless of the specific form of the form of the European Union, the development goal of the EU must be a new social community to meet the interests of the European people in the traditional national framework. In essence, the EU constitutionalism is the fundamental value and rules necessary for the establishment of the European Union as a new social community. The function of EU constitutionalism is mainly reflected in the confirmation of the legitimacy of the new social community, the molding of collective identity, the construction of the value system and the establishment of the institutional framework. The ratification and entry into force of the Lisbon treaty does not mean the end of the constitutional process of the EU, but it is only one of the original elitist propelled EU constitutional treaties. In essence, it is still a substantive achievement in the dynamic generation process of the EU constitution.
