【摘要】：隨著人類文明的進(jìn)步和環(huán)境保護(hù)意識(shí)的增強(qiáng),動(dòng)物保護(hù)和保障動(dòng)物福利的理念已深入人心。另一方面,由于傳統(tǒng)貿(mào)易壁壘的逐漸沒落,新型的由動(dòng)物福利引發(fā)的貿(mào)易摩擦也日漸增多。因此,從法律的角度分析和研究動(dòng)物福利貿(mào)易壁壘有著深刻的現(xiàn)實(shí)和理論意義。 本文由四個(gè)部分組成: 第一部分是對(duì)動(dòng)物福利概念的概述。其中分別介紹了動(dòng)物福利的法律內(nèi)涵、發(fā)展歷史和各國的立法概況,從宏觀的角度展現(xiàn)了動(dòng)物福利立法的悠久歷史及其進(jìn)步意義。第二部分是對(duì)動(dòng)物福利貿(mào)易壁壘的概述分析。其中將動(dòng)物福利貿(mào)易壁壘的概念同相類似的概念進(jìn)行了對(duì)比分析,以便進(jìn)一步明確動(dòng)物福利貿(mào)易壁壘作為一種新型的貿(mào)易壁壘的特殊性。并且基于其特殊性闡述了動(dòng)物福利貿(mào)易壁壘產(chǎn)生的原因。第三部分評(píng)述了動(dòng)物福利貿(mào)易壁壘在WTO框架下潛在的法律依據(jù)和可能被應(yīng)用的形式。同時(shí)依據(jù)近年來我國國際貿(mào)易中實(shí)際案例分析對(duì)我國禽畜產(chǎn)業(yè)、傳統(tǒng)中醫(yī)藥產(chǎn)業(yè)和皮毛產(chǎn)業(yè)國際貿(mào)易的影響。第四部分評(píng)析了我國目前動(dòng)物保護(hù)立法狀況,其中重點(diǎn)介紹了近期我國動(dòng)物保護(hù)立法發(fā)展趨勢,并且從國際法和國內(nèi)法兩個(gè)層面分別提出應(yīng)對(duì)動(dòng)物福利貿(mào)易壁壘的對(duì)策。
[Abstract]:With the progress of human civilization and the enhancement of environmental protection consciousness, the concept of animal protection and protection of animal welfare has been deeply accepted. On the other hand, due to the decline of traditional trade barriers, new trade frictions caused by animal welfare are also increasing. Therefore, it has profound realistic and theoretical significance to analyze and study animal welfare trade barriers from the angle of law. This paper consists of four parts: the first part is an overview of the concept of animal welfare. It introduces the legal connotation of animal welfare, the history of development and the general situation of legislation in various countries, and shows the long history of animal welfare legislation and its progressive significance from the macro point of view. The second part is an overview of animal welfare barriers to trade. The concept of animal welfare trade barriers is compared with similar concepts in order to further clarify the particularity of animal welfare trade barriers as a new type of trade barriers. And on the basis of its particularity elaborated the animal welfare trade barrier causes. The third part reviews the potential legal basis and possible application of animal welfare trade barriers under the WTO framework. At the same time, according to the actual cases of China's international trade in recent years, the impact on China's livestock industry, traditional Chinese medicine industry and fur industry international trade is analyzed. The fourth part analyzes the current situation of animal protection legislation in China, which focuses on the recent development trend of animal protection legislation in China, and puts forward countermeasures to deal with animal welfare trade barriers from the two aspects of international law and domestic law.
