【摘要】：目前,世界范圍內(nèi)出現(xiàn)了公共健康危機,沒有哪個國家能置身事外。作為一個全球性的危機,維護公共健康的任務(wù)擺在了我們所有人面前,然而,在公共健康危機日益嚴(yán)重的今天,知識產(chǎn)權(quán)卻仍在不斷的擴張,以至于對公共健康危機的解決造成了嚴(yán)重阻礙,知識產(chǎn)權(quán)有其價值追求,其關(guān)鍵在于平衡知識產(chǎn)權(quán)創(chuàng)作者個人和社會大眾及社會整體發(fā)展之間的利益,而公共健康是健康權(quán)的一個方面,屬于基本人權(quán),維護公共健康就是保障人們最基本的利益。在兩者相沖突的今天,我們應(yīng)努力探索解決這一沖突的原則和措施。本文通過對知識產(chǎn)權(quán)的概念、發(fā)展及屬性的分析,揭示了知識產(chǎn)權(quán)制度的價值追求,通過對公共健康的概念、特點及現(xiàn)狀的探討,明確了其基本人權(quán)的屬性及所面臨的危機,通過深入探討沖突的根本原因揭示了解決這一沖突的途徑,從而最終得出了工具主義、人權(quán)優(yōu)先及利益平衡等處理知識產(chǎn)權(quán)保護與公共健康維護的原則,并就具體措施提出了自己的建議。本文旨在為知識產(chǎn)權(quán)保護與公共健康維護之沖突的協(xié)調(diào)提供些許參考,從而促進這一問題的解決,更好的保護人們的權(quán)利。
[Abstract]:Today, there is a public health crisis around the world, and no country can stay out of it. As a global crisis, the task of maintaining public health is in front of all of us. However, in today's public health crisis, intellectual property rights are still expanding. So that the solution of the public health crisis caused serious obstacles, intellectual property has its value to pursue, the key is to balance the interests of the intellectual property creator individual and the general public and social development as a whole. Public health is an aspect of the right to health, belonging to the basic human rights, to safeguard public health is to protect the most basic interests of people. In today's conflict, we should try to explore the principles and measures to resolve the conflict. Through the analysis of the concept, development and attribute of intellectual property, this paper reveals the value pursuit of intellectual property system, and through the discussion of the concept, characteristics and present situation of public health, it clarifies the attribute of its basic human rights and the crisis it faces. By deeply exploring the root causes of the conflict, it reveals the way to resolve the conflict, and finally comes to the principles of instrumentalism, human rights priority and balance of interests in dealing with the protection of intellectual property rights and the maintenance of public health. And put forward their own suggestions on specific measures. The purpose of this paper is to provide some references for the coordination of the conflict between intellectual property protection and public health maintenance so as to promote the solution of this problem and better protect people's rights.
