【摘要】：提單是國(guó)際貿(mào)易的重要單證,其是貨物所有權(quán)的象征。經(jīng)過(guò)幾個(gè)世紀(jì)的發(fā)展,提單推動(dòng)了國(guó)際貿(mào)易的發(fā)展,使國(guó)際貿(mào)易從實(shí)物交易發(fā)展到了單證交易。從二十世紀(jì)初以來(lái),圍繞提單方面的立法有三個(gè)國(guó)際公約以及英美等國(guó)家的提單法,提單方面的立法為提單的發(fā)展和規(guī)制起了重要作用。在國(guó)際經(jīng)濟(jì)一體化的今天,提單欺詐行為日益猖獗,嚴(yán)重影響了提單的基本制度,破壞了提單的信譽(yù),對(duì)國(guó)際貿(mào)易的順利發(fā)展造成了某種程度的阻礙。面對(duì)我們國(guó)家在反提單欺詐方面的立法不足,本文通過(guò)對(duì)比分析英美這兩個(gè)超級(jí)貿(mào)易大國(guó)以及國(guó)際公約對(duì)反提單欺詐方面的立法,從中找出其立法的合理之處以供我們國(guó)家在反提單欺詐立法方面做參考。 本文首先從提單欺詐的主客觀原因入手,對(duì)提單欺詐發(fā)生的原因進(jìn)行分析。為討論下面的問(wèn)題做了鋪墊。第二章主要寫了提單欺詐的主要表現(xiàn)形式。第三章,通過(guò)對(duì)比較分析英美這兩個(gè)貿(mào)易大國(guó)以及國(guó)際公約對(duì)提單欺詐的各種表現(xiàn)形式的立法規(guī)制,找出他們其中最合理之處以供我們?cè)诜刺釂纹墼p立法方面做借鑒。第四章,分兩部分,第一部分是對(duì)我國(guó)在反提單欺詐方面的立法建議,先闡述我國(guó)對(duì)每種提單欺詐的立法規(guī)定找出不足之處,然后對(duì)每一種欺詐形式做了立法建議。第二部分是在實(shí)踐操作中對(duì)提單欺詐應(yīng)該采取哪些防范措施。 本文以反提單欺詐為主要線索,以解決提單欺詐為主要目的。通過(guò)比較和案例分析的方法,得出反提單欺詐的立法建議。
[Abstract]:Bill of lading is an important document in international trade, it is the symbol of ownership of goods. After centuries of development, the bill of lading has promoted the development of international trade, and international trade has developed from physical transactions to document transactions. Since the beginning of the 20th century, there are three international conventions on bill of lading and the laws of bill of lading in Britain and America. The legislation of bill of lading plays an important role in the development and regulation of bill of lading. With the international economic integration, the fraud of bill of lading is rampant day by day, which seriously affects the basic system of bill of lading, destroys the credibility of bill of lading, and impedes the smooth development of international trade to some extent. In the face of our country's lack of legislation on anti-bill of lading fraud, this paper compares and analyzes the legislation on anti-bill of lading fraud in Britain and the United States, the two super trading countries, and the international conventions on anti-bill of lading fraud. To find out the legislation of its reasonable penalties for our country in anti-bill of lading fraud legislation for reference. In this paper, the subjective and objective reasons of bill of lading fraud are analyzed. This paves the way for discussion of the following issues. The second chapter mainly describes the main manifestations of bill of lading fraud. The third chapter, through the comparative analysis of the two major trading countries, as well as the international conventions on the bill of lading fraud of various forms of legislative regulation, find out their most reasonable punishment for our anti-bill of lading fraud legislation for reference. The fourth chapter is divided into two parts. The first part is the legislative suggestions on anti-bill of lading fraud in our country. First, the legislative provisions of each kind of bill of lading fraud in our country to find out the deficiencies, and then to each form of fraud to make legislative recommendations. The second part is what precautions should be taken against bill of lading fraud in practice. This article takes the anti-bill of lading fraud as the main clue and solves the bill of lading fraud as the main purpose. Through comparison and case analysis, the legislative suggestions of anti-bill of lading fraud are obtained.
