【摘要】：傳統(tǒng)知識(shí)國(guó)際保護(hù)規(guī)則以《建立世界知識(shí)產(chǎn)權(quán)組織公約》和《生物多樣性公約》兩個(gè)國(guó)際公約為基礎(chǔ),并經(jīng)歷了不斷改進(jìn)和完善的過(guò)程,其公平與正義因素在逐漸加強(qiáng)。自然資源永久主權(quán)以及公平合理分享利用惠益的原則與方針,都為解決傳統(tǒng)知識(shí)的知識(shí)產(chǎn)權(quán)保護(hù)問(wèn)題確立了指導(dǎo)原則。
[Abstract]:The rules for the international protection of traditional knowledge are based on the two international conventions, the Convention on the Establishment of the World intellectual property Organization (WIPO) and the Convention on Biological Diversity (CBD), and have undergone continuous improvement and improvement. The factors of fairness and justice have been gradually strengthened. The principles and principles of permanent sovereignty over natural resources and equitable and reasonable sharing of the benefits of utilization have established guiding principles for the protection of intellectual property rights of traditional knowledge.
