【摘要】:地理標(biāo)志作為TRIPS協(xié)定明確規(guī)定的知識(shí)產(chǎn)權(quán),保護(hù)地理標(biāo)志是每個(gè)WTO成員國(guó)的義務(wù)。地理標(biāo)志保護(hù)起源于法國(guó),逐步被其他歐洲國(guó)家效仿,擴(kuò)展于世界。許多國(guó)際條約都涉及地理標(biāo)志保護(hù),直到地理標(biāo)志被納入TRIPS協(xié)定,使得地理標(biāo)志成為WTO最為熱門的議題之一。對(duì)于建立何種地理標(biāo)志保護(hù)機(jī)制和是否擴(kuò)大地理標(biāo)志產(chǎn)品保護(hù)范圍,形成了以美國(guó)為首和以歐盟為首的兩大對(duì)立陣營(yíng)。 歐盟的農(nóng)產(chǎn)品地理標(biāo)志法律制度不僅是世界上地理標(biāo)志專門法保護(hù)模式的典型代表,而且對(duì)地理標(biāo)志的保護(hù)也是其他國(guó)家所不可比擬的。歐盟之所以對(duì)地理標(biāo)志的重視與其經(jīng)濟(jì)利益密不可分,地理標(biāo)志保護(hù)在歐洲已超過(guò)一百年,其地理標(biāo)志法律制度相當(dāng)完善,對(duì)其它國(guó)家的地理標(biāo)志立法具有借鑒意義。由于中國(guó)的地理標(biāo)志保護(hù)制度借鑒不同國(guó)家的立法模式,所以形成了商標(biāo)法模式和專門法模式并存的格局,這種保護(hù)機(jī)制在現(xiàn)實(shí)中引發(fā)了不少問(wèn)題,亟待完善。本文通過(guò)對(duì)歐盟農(nóng)產(chǎn)品地理標(biāo)志法律保護(hù)的分析和探討,希望對(duì)中國(guó)地理標(biāo)志立法的完善提供一些啟示。 本文分為四部分(不包括引言和結(jié)語(yǔ)),第一部分為歐盟農(nóng)產(chǎn)品地理標(biāo)志法律保護(hù)歷史沿革。以TRIPS協(xié)定為界限劃分為兩個(gè)時(shí)期,主要闡述歐盟農(nóng)產(chǎn)品地理標(biāo)志法律及變化原因,首先明確前TRIPS時(shí)代的主要法律為2081/92條例,其次論述后TRIPS時(shí)代由2081/92條例到510/2006條例的演變,除此之外,還介紹歐盟通過(guò)與第三國(guó)簽訂自由貿(mào)易協(xié)定來(lái)實(shí)現(xiàn)歐盟農(nóng)產(chǎn)品地理標(biāo)志的域外保護(hù)和在WTO貿(mào)易談判中歐盟對(duì)農(nóng)產(chǎn)品地理標(biāo)志保護(hù)的立場(chǎng);第二部分是歐盟農(nóng)產(chǎn)品地理標(biāo)志法律保護(hù)制度。這一部分主要從歐盟510/2006條例著手,重點(diǎn)描述510/2006條例的立法目的、保護(hù)范圍、注冊(cè)和撤銷程序及地理標(biāo)志和商標(biāo)的關(guān)系。第三部分對(duì)歐盟農(nóng)產(chǎn)品地理標(biāo)志法律制度的評(píng)析。在這一部分中,對(duì)歐盟地理標(biāo)志主要評(píng)價(jià)涉及立法模式、保護(hù)水平、立法內(nèi)容、政策目標(biāo)并得出歐盟農(nóng)產(chǎn)品地理標(biāo)志保護(hù)經(jīng)驗(yàn)對(duì)中國(guó)的啟示。第四部分是中國(guó)農(nóng)產(chǎn)品地理標(biāo)志法律保護(hù)的完善。從分析中國(guó)現(xiàn)有農(nóng)產(chǎn)品地理標(biāo)志保護(hù)模式及存在問(wèn)題入手,結(jié)合歐盟經(jīng)驗(yàn)進(jìn)而得出中國(guó)農(nóng)產(chǎn)品地理標(biāo)志法律完善的措施。
[Abstract]:As intellectual property rights explicitly stipulated in trips Agreement, it is the duty of every WTO member to protect geographical indications. The protection of geographical indications originated in France and was gradually imitated by other European countries and extended to the world. Many international treaties deal with the protection of geographical indications until they are included in trips Agreement, which makes geographical indications one of the most popular topics in WTO. As to what kind of geographical indication protection mechanism should be established and whether to expand the scope of protection of geographical indication products, two opposing camps, led by the United States and the European Union, have been formed. The legal system of geographical indication of agricultural products in the European Union is not only a typical representative of the protection mode of the special law of geographical indication in the world, but also the protection of geographical indications is unparalleled by other countries. The reason why the EU attaches importance to geographical indications is closely related to its economic interests. The protection of geographical indications has been in Europe for more than 100 years, and its legal system of geographical indications is quite perfect, which has reference significance to other countries' legislation of geographical indications. Since China's geographical indication protection system draws lessons from the legislative models of different countries, it has formed a pattern of trademark law and special law. This protection mechanism has caused many problems in reality and needs to be improved. Through the analysis and discussion on the legal protection of the geographical indications of agricultural products in the European Union, this paper hopes to provide some enlightenment for the perfection of the legislation of geographical indications in China. This paper is divided into four parts (excluding introduction and conclusion). The first part is the history of the legal protection of agricultural products. The trips Agreement is divided into two periods, mainly expounding the laws of the EU agricultural products geographical indications and the reasons for their changes. Firstly, it is clear that the main laws of the pre-trips era are the 2081 / 92 regulations, and secondly, the evolution of the post-TRIPS era from 2081 / 92 to 510 / 2006 is discussed. In addition, it also introduces the EU's position on the protection of geographical indications of agricultural products in WTO trade negotiations by signing free trade agreements with third countries to realize the extraterritorial protection of the EU's geographical indications of agricultural products. The second part is the legal protection system of EU agricultural products geographical indication. This part starts with the European Union's 510 / 2006 Regulation, which focuses on the legislative purposes, the scope of protection, the registration and revocation procedures, and the relationship between geographical indications and trademarks. The third part comments on the legal system of EU agricultural products geographical indication. In this part, the main evaluation of EU geographical indications involves legislative model, level of protection, content of legislation, policy objectives and the enlightenment to China from the experience of EU geographical indication protection of agricultural products. The fourth part is the perfection of the legal protection of the geographical indication of agricultural products in China. Based on the analysis of the existing protection mode and existing problems of agricultural products in China, combined with the experience of the European Union, the measures to perfect the laws of the geographical indications of agricultural products in China are obtained.
