我國(guó)孤兒作品的利用困境與解決機(jī)制研究

【摘要】:孤兒作品一詞由“orphan works”直譯而來(lái),指聯(lián)系不到權(quán)利人的作品。上世紀(jì)90年代末,孤兒作品問(wèn)題首先在美國(guó)引起關(guān)注,并形成了兩個(gè)孤兒作品法案草案,其他國(guó)家和國(guó)際組織也紛紛就該問(wèn)題提出對(duì)策。我國(guó)著作權(quán)法上沒(méi)有與孤兒作品對(duì)應(yīng)的概念,但根據(jù)其含義,可以確定我國(guó)也存在孤兒作品問(wèn)題。然而目前該問(wèn)題在我國(guó)尚未引起廣泛關(guān)注,相關(guān)研究較少且多側(cè)重于介紹國(guó)外做法。在前人基礎(chǔ)上,本文主要做了以下研究:首先,筆者采用歷史發(fā)展的眼光看待孤兒作品問(wèn)題,總結(jié)出了產(chǎn)生孤兒作品的兩大背景,即版權(quán)擴(kuò)張趨勢(shì)和數(shù)字技術(shù)的發(fā)展;孤兒作品問(wèn)題發(fā)展的三個(gè)階段,即“前《伯爾尼公約》時(shí)代”、“《伯爾尼公約》時(shí)代”和“數(shù)字時(shí)代”;孤兒作品問(wèn)題的實(shí)質(zhì),即孤兒作品的“利用困境”、“利用難點(diǎn)”。其次,梳理了我國(guó)的孤兒作品相關(guān)案例,分為非數(shù)字環(huán)境下的案例和數(shù)字環(huán)境下的案例,從側(cè)面展示了我國(guó)孤兒作品的利用現(xiàn)狀。最后,,本文認(rèn)為我國(guó)可以采用法定許可制度解決孤兒作品問(wèn)題,并初步構(gòu)建了制度框架,包括“合理勤勉尋找”標(biāo)準(zhǔn)、許可使用費(fèi)制度、權(quán)利人復(fù)出制度、版權(quán)說(shuō)明制度等。
[Abstract]:The word "orphan works" is a literal translation of "orphan works" and refers to works that do not relate to the obligee. At the end of 1990s, the problem of orphans' works first attracted attention in the United States, and two drafts of orphan works bill were formed. Other countries and international organizations also put forward countermeasures to this problem one after another. There is no concept corresponding to orphan works in copyright law of our country, but according to its meaning, it can be determined that there are problems of orphan works in our country. However, at present, this problem has not attracted much attention in our country, and the related research is less and more focused on the introduction of foreign practices. On the basis of predecessors, this paper mainly does the following research: first, the author uses the historical development perspective to look at the problem of orphan works, summed up the two major backgrounds for the generation of orphan works, namely, the trend of copyright expansion and the development of digital technology; There are three stages in the development of orphans' works, namely, "the era of the Berne Convention", "the era of the Berne Convention" and "the digital age", and the essence of the problem of orphans' works, that is, the "utilization dilemma" and "the difficulty of utilization" of the orphan's works. Secondly, it combs the related cases of the orphans' works in our country, divides them into the cases under the non-digital environment and the cases under the digital environment, and shows the present situation of the utilization of the orphans' works in China from the side. Finally, this paper thinks that our country can adopt the legal license system to solve the problem of orphans' works, and preliminarily constructs the institutional framework, including the standard of "reasonable and diligent search", the system of license usage fee, the system of right holders' return, the system of copyright description, and so on.
