論紅樹林的國(guó)際環(huán)境法保護(hù)

【摘要】:本文主要由前言、正文和結(jié)論三部分組成。 前言部分重在闡述本選題的意義,作為正文論述的楔子。 正文分為四章。第一章為紅樹林及其法律保護(hù)概述,介紹了紅樹林的獨(dú)特概念及其不可替代的重要價(jià)值,并通過(guò)展示當(dāng)下破壞嚴(yán)重的現(xiàn)實(shí),將之與現(xiàn)有的法律保護(hù)規(guī)則的不完善相對(duì)比,強(qiáng)調(diào)保護(hù)的重要性、必要性與迫切性。 第二章論述紅樹林保護(hù)中的國(guó)際環(huán)境法原則,重點(diǎn)闡釋了這些原則在現(xiàn)有制度中的條約基礎(chǔ)、具體體現(xiàn)及發(fā)展方向。其中首先包括的是預(yù)防原則,作者并建議建立健全風(fēng)險(xiǎn)評(píng)估制度;其次包括合理使用原則,作者展望了自然資源的有償使用的推行;再次包括可持續(xù)發(fā)展原則,主要體現(xiàn)為“生境恢復(fù)”的理念與規(guī)定;最后包括共同責(zé)任原則,尤其應(yīng)特別考慮發(fā)展中國(guó)家的利益,這也符合紅樹林保護(hù)的實(shí)際與需要。 第三章側(cè)重于紅樹林保護(hù)義務(wù)的履行。首先,根據(jù)相關(guān)的國(guó)際條約,特別是《濕地公約》和《生物多樣性公約》的規(guī)定,本文主要分析了國(guó)家在四個(gè)方面的履約義務(wù),并結(jié)合條約與理論,為各項(xiàng)義務(wù)的更好履行提出建議。其次,論述了與紅樹林保護(hù)相關(guān)的重要國(guó)際組織,重點(diǎn)剖析了相關(guān)國(guó)際組織的重要作用。最后,考慮到生存與環(huán)境的矛盾的解決,作者依次討論了生物小額信貸、全球環(huán)境基金和《濕地公約》自身的資金制度。 第四章關(guān)注紅樹林保護(hù)的監(jiān)督,既論述了現(xiàn)有國(guó)際環(huán)境條約中規(guī)定的締約方大會(huì)制度,也從“不遵守情事程序”和個(gè)人的主體地位兩個(gè)角度,展望了監(jiān)督機(jī)制的發(fā)展方向。 結(jié)論中,作者回顧全文,歸納提出:無(wú)論規(guī)則和制度如何取向與發(fā)展,終歸只是為了一個(gè)目的——保護(hù)紅樹林,保護(hù)我們的地球家園。
[Abstract]:This paper consists of three parts: preface, text and conclusion. The preface focuses on the significance of this topic, as the wedge of the text. The text is divided into four chapters. The first chapter is an overview of mangrove and its legal protection. It introduces the unique concept of mangrove and its irreplaceable important value, and compares it with the imperfections of existing legal protection rules by showing the present seriously damaged reality. Emphasize the importance, necessity and urgency of protection. The second chapter discusses the principles of international environmental law in mangrove conservation, focusing on the treaty basis of these principles in the existing system, concrete embodiment and development direction. The first is the precautionary principle, and the author recommends the establishment of a sound risk assessment system; the second includes the principle of rational use, the author looks forward to the implementation of the compensatory use of natural resources, and the third includes the principle of sustainable development. Finally, the principle of common responsibility, especially the interests of developing countries, should be taken into account, which is also in line with the actual and needs of mangrove conservation. The third chapter focuses on the implementation of mangrove protection obligations. First of all, according to the relevant international treaties, especially the Convention on Wetlands and the Convention on Biological Diversity, this paper mainly analyzes the implementation obligations of countries in four aspects, and combines treaties and theories. Make recommendations for better performance of obligations. Secondly, the important international organizations related to mangrove conservation are discussed, with emphasis on the important role of relevant international organizations. Finally, considering the solution of the contradiction between survival and environment, the author discusses the bio-microfinance, the Global Environment Facility and the Wetland Convention's own financial system in turn. The fourth chapter focuses on the supervision of mangrove protection. It not only discusses the system of the Conference of the parties stipulated in the existing international environmental treaties, but also looks forward to the development direction of the monitoring mechanism from the point of view of "non-compliance procedure" and the subject status of the individual. In conclusion, the author reviews the full text and concludes that no matter how the rules and systems are oriented and developed, it is only for the purpose of protecting mangroves and protecting our earth and homeland.
