【摘要】：相比以往關(guān)稅與貿(mào)易總協(xié)定/世界貿(mào)易組織實(shí)踐主要是圍繞產(chǎn)品市場(chǎng)準(zhǔn)入問(wèn)題的爭(zhēng)議,"中國(guó)原材料出口限制措施案"則是世界貿(mào)易組織成員圍繞資源出口限制問(wèn)題展開(kāi)的一場(chǎng)資源獲取的"攻防戰(zhàn)",體現(xiàn)了全球經(jīng)濟(jì)的競(jìng)爭(zhēng)方式由"市場(chǎng)準(zhǔn)入"到"資源獲取"的轉(zhuǎn)變。這場(chǎng)"攻防戰(zhàn)"不僅提出了出口限制措施在世界貿(mào)易組織法上之地位、《關(guān)稅與貿(mào)易總協(xié)定》第20條與資源出口限制措施的關(guān)系以及新加入成員"超世界貿(mào)易組織義務(wù)"的解釋等一系列在世界貿(mào)易組織法上尚待澄清的問(wèn)題,而且對(duì)國(guó)際貿(mào)易和世界貿(mào)易組織法也將產(chǎn)生深遠(yuǎn)影響。
[Abstract]:Compared with the previous GATT / WTO practice, the dispute mainly revolves around the issue of market access for products, while the case on Export restriction measures for China's Raw Materials is a question of resource export restrictions for members of the World Trade Organization. The "attack and defense war" launched by the paper reflects the change from "market access" to "resource acquisition" in the competitive mode of the global economy. This "offensive and defensive war" not only puts forward the status of export restriction measures in the WTO, the relationship between Article 20 of the General Agreement on tariffs and Trade (GATT) and resource export restriction measures, and the new accession to the "Trans-World Trade Organization" The interpretation of "obligations" and a series of issues that remain to be clarified in the field of the World Trade Organization Act, And will also have a profound impact on international trade and world trade law.
