【摘要】：近年來,不少學者們對歐盟的共同農業(yè)政策進行了廣泛的研究,但是這些研究大部分都集中在宏觀層面,真正深入分析其具體制度、措施的不多。實際上,對具體制度的研究可以為我國相關法律、制度、措施的建立健全提供非常好的借鑒�；诖�,文章試圖通過對共同農業(yè)政策中的具體制度,即交叉遵守制度的研究來分析介紹歐盟在農業(yè)環(huán)境補貼方面的具體規(guī)定、相關程序以及實踐效果,以期促進我國農業(yè)環(huán)境補貼法律制度建設的進一步發(fā)展。 文章首先對最近的共同農業(yè)政策改革的原因進行分析,認為財政負擔加重、歐盟東擴、國際貿易關注、政治、社會矛盾和社會成本增加、環(huán)境關注與食品安全的壓力是導致歐盟進行共同農業(yè)政策改革的最主要原因。然后在此基礎上簡要介紹了交叉遵守制度的正式確立。論文的第二部分則重點闡述了交叉遵守制度的形成與發(fā)展,并對交叉遵守制度的三個基礎理論,即農業(yè)多功能性理論、環(huán)境政策一體化理論以及污染者付費理論予以介紹。論文的第三部分詳細闡述了交叉遵守制度的基本內容,包括交叉遵守的標準以及對于違反交叉遵守規(guī)定的農民的處罰機制。第四部分則對交叉遵守制度在實際中的應用進行了分析介紹。論文的第五部分從關聯(lián)性、有效性、效率性和比例性四個方面對交叉遵守制度的實施成效進行評價,并對交叉遵守制度在實踐中暴露出來的問題進行分析,提出了解決對策。最后,提出了交叉遵守制度對于我國農業(yè)政策改革的啟示,即農業(yè)補貼立法應強化農業(yè)與環(huán)境協(xié)調發(fā)展理念、引進交叉遵守制度、精設項目,促進農民增收、可持續(xù)發(fā)展的農業(yè)環(huán)境補貼制度以及逐步建立與生產不掛鉤的收入補貼制度。
[Abstract]:In recent years, many scholars have carried out extensive research on the common agricultural policy of the European Union, but most of these studies are focused on the macro level, the real in-depth analysis of its specific system, the measures are few. In fact, the study of specific system can provide very good reference for the establishment and perfection of relevant laws, systems and measures in our country. Based on this, this paper attempts to analyze and introduce the EU's specific regulations on agricultural environmental subsidies, relevant procedures and practical effects through the research on the specific system of common agricultural policy, that is, the system of cross-compliance. In order to promote the further development of the legal system of agricultural environmental subsidy in China. The article first analyzes the causes of the recent common agricultural policy reform, and holds that the financial burden is increasing, the EU is expanding eastward, international trade is concerned, political, social contradictions and social costs are increasing. Environmental concerns and pressure on food safety are the main causes of EU common agricultural policy reform. Then it briefly introduces the formal establishment of cross-compliance system. The second part focuses on the formation and development of cross compliance system, and introduces three basic theories of cross compliance system, namely, agriculture multifunctional theory, environmental policy integration theory and polluter pays theory. The third part elaborates the basic content of cross compliance system, including the standards of cross compliance and the punishment mechanism for farmers who violate the regulations of cross compliance. The fourth part analyzes the application of cross-compliance system in practice. The fifth part of the paper evaluates the effectiveness of the implementation of cross compliance system from four aspects: relevance, effectiveness, efficiency and proportionality, and analyzes the problems exposed in the practice of cross compliance system, and puts forward some countermeasures. Finally, the paper puts forward the enlightenment of cross compliance system to the reform of agricultural policy in China, that is, agricultural subsidy legislation should strengthen the concept of coordinated development between agriculture and environment, introduce cross compliance system, elaborate projects, and promote farmers' income. The sustainable development of agricultural environment subsidy system and the establishment of income subsidy system not linked to production.
