【摘要】：空域是航空活動的主要場域,空域權(quán)利是航空法的發(fā)展基石。然而我國對空域權(quán)利的研究尚未充分展開。有關(guān)空間權(quán)的研究限于物權(quán)法范疇,無法對空域權(quán)利制度的構(gòu)建提供理論與制度支撐。文章研究了空域權(quán)的對象及其與物權(quán)空間的區(qū)別與聯(lián)系,指出空氣空間應(yīng)當(dāng)依據(jù)航空飛行的最低安全高度的水平面為界區(qū)分為空域及其下的物權(quán)空間。空域權(quán)與物權(quán)法意義上的空間權(quán)雖具有諸多相似性,但區(qū)別更為突出。國家對空域的所有權(quán)為憲法性所有權(quán),由此,其權(quán)利制度應(yīng)當(dāng)以國家干預(yù)下的公共產(chǎn)品利用權(quán)為核心進(jìn)行構(gòu)建,不宜參照海域使用權(quán)的制度模式。
[Abstract]:Airspace is the main field of aviation activities, and airspace rights is the cornerstone of the development of air law. However, the study of airspace rights in China has not been fully carried out. The research on space right is limited to the category of property law, and it can not provide theoretical and institutional support for the construction of airspace right system. This paper studies the object of airspace right and its difference and relation with real right space, and points out that air space should be divided into airspace and real right space under air space according to the horizontal plane of the lowest safe height of aviation flight. Although there are many similarities between the spatial right and the space right in the sense of property law, the difference is more prominent. The state's ownership of airspace is constitutional. Therefore, the system of rights should be constructed with the right to use public goods under the state intervention as the core, and it is not appropriate to refer to the system model of the right to use the sea area.
