【摘要】：“對一切”義務(wù)即對國際社會整體的義務(wù),對國際社會整體的義務(wù)反映了國際法價值論的變化,國際法的價值不僅僅是國家之間的價值,在國家價值之上還有國際社會的共同利益。作為國際法的一項規(guī)則,“對一切”義務(wù)在國際法院的審判中發(fā)揮了十分重要的作用,它被初次提出并應(yīng)用于國際法院是在對巴塞羅那牽引公司案的審判當(dāng)中,從那時起“對一切”義務(wù)頻頻出現(xiàn)在國際法院的判決或國際法院大法官的個別意見書當(dāng)中。而關(guān)于“對一切”義務(wù)的爭論也一直沒有停止過,從它的概念到它的適用范圍,再到它的發(fā)展方向,都是各國法學(xué)家們討論的話題。爭議雖多,但有一點是公認的,“對一切”義務(wù)符合國際社會的發(fā)展趨勢,其在國際法院審判活動中發(fā)揮的作用將會越來越大,這就要求我們在解決爭議的過程中不斷的豐富和發(fā)展這一規(guī)則。
[Abstract]:"towards all" obligations are obligations to the international community as a whole, and obligations to the international community as a whole reflect a change in the axiology of international law, the value of which is not only between States, There is also the common interest of the international community above national values. As a rule of international law, the "all for all" obligation has played a very important role in the trial of the International Court of Justice, which was first introduced and applied in the trial of Barcelona traction Corporation, Since then, "all obligations" have frequently appeared in the judgments of the International Court of Justice or in individual opinions of the judges of the International Court of Justice. And the debate about "all" obligations has never stopped, from its concept to its scope of application, and then to its development direction, are the topics discussed by jurists from all over the world. Although there are many disputes, it is recognized that the obligation "towards all" is in line with the trend of development in the international community and will play an increasing role in the proceedings of the International Court of Justice, This requires us to constantly enrich and develop this rule in the process of resolving disputes.
