【摘要】：烏拉圭回合以來,衛(wèi)生與植物檢疫(SPS)措施在國際貿(mào)易中的作用凸顯,對(duì)我國農(nóng)產(chǎn)品出口的影響也越來越大。文章通過1995年以來WTO爭(zhēng)端解決機(jī)制裁定的5件SPS典型案例,從科學(xué)觀點(diǎn)、風(fēng)險(xiǎn)評(píng)估、一致性、最低貿(mào)易限制以及透明度等方面進(jìn)行了詳細(xì)分析,并針對(duì)我國現(xiàn)狀提出四條建設(shè)性的意見,為我國政府和企業(yè)運(yùn)用國際規(guī)則應(yīng)對(duì)有關(guān)SPS貿(mào)易爭(zhēng)議案提供了依據(jù)。
[Abstract]:Since Uruguay Round, sanitary and phytosanitary (SPS) measures have played an important role in international trade, and the impact on China's agricultural exports has become more and more serious. Based on five typical cases of SPS adjudicated by the WTO dispute settlement mechanism since 1995, this paper makes a detailed analysis from the scientific point of view, risk assessment, consistency, minimum trade restrictions and transparency, etc. Four constructive suggestions are put forward in view of the present situation of our country, which provides the basis for our government and enterprises to use international rules to deal with SPS trade disputes.
