國(guó)際法和國(guó)際政治二元視角下的南海爭(zhēng)端解決路徑探析

【摘要】:南海自古以來(lái)就是中國(guó)的領(lǐng)土,從秦朝中國(guó)就發(fā)現(xiàn)了南海,并從漢代開始就對(duì)南海開發(fā)、經(jīng)營(yíng)和進(jìn)行行政管轄。但是從20世紀(jì)70年代開始,隨著南海地區(qū)豐富的油氣資源被勘探和80年代《聯(lián)合國(guó)海洋法公約》的簽署,南海周邊的越南、菲律賓、馬來(lái)西亞、文萊等國(guó)家開始對(duì)南海主張權(quán)益,并且無(wú)視中國(guó)的反對(duì),紛紛侵占部分南海島嶼,并對(duì)南海資源進(jìn)行開發(fā),尤其是美國(guó)、日本等國(guó)家以各種借口的介入,使得南海問(wèn)題日趨復(fù)雜多變,如何和平解決南海爭(zhēng)端,如何在維護(hù)國(guó)家主權(quán)利益和維護(hù)與東南亞各國(guó)睦鄰友好關(guān)系之間找到恰當(dāng)?shù)钠胶恻c(diǎn),是擺在中國(guó)政府面前的一道難題。本文圍繞南海問(wèn)題的解決路徑展開論述。第一部分的緒論中對(duì)本文的選題原因、國(guó)內(nèi)外的研究情況、研究意義和重難點(diǎn)以及研究方法和創(chuàng)新處進(jìn)行了分析;第二部分對(duì)南海相關(guān)問(wèn)題進(jìn)行了分析,進(jìn)而結(jié)合當(dāng)前南海問(wèn)題的局勢(shì)和現(xiàn)狀,得出南海問(wèn)題具有法律和政治雙重屬性的結(jié)論,在此基礎(chǔ)上提出南海問(wèn)題的妥善解決應(yīng)當(dāng)以堅(jiān)持南海主權(quán)歸我為前提,再?gòu)姆珊驼蝺蓚(gè)角度去解決。第三部分針對(duì)南海主權(quán)歸我的前提進(jìn)行法理分析,依據(jù)歷史事實(shí)和國(guó)際法,夯實(shí)這一前提的合法性基礎(chǔ)。第四部分從國(guó)際政治的角度理清爭(zhēng)端各國(guó)對(duì)南海的利益訴求,為之后提出解決對(duì)策奠定政治分析的基礎(chǔ)。第五部分從法律和政治兩個(gè)角度提出中國(guó)應(yīng)當(dāng)如何妥善解決南海問(wèn)題,最終得出結(jié)論:妥善解決南海問(wèn)題,需要法律和政治手段應(yīng)當(dāng)并行適用,缺一不可。
[Abstract]:The South China Sea has been the territory of China since ancient times. The South China Sea has been discovered since the Qin Dynasty and has been under administrative jurisdiction since the Han Dynasty. But since the 1970s, with the exploration of rich oil and gas resources in the South China Sea and the signing of the United Nations Convention on the Law of the Sea in the 1980s, Vietnam, the Philippines and Malaysia around the South China Sea, Brunei and other countries began to assert their rights and interests in the South China Sea, ignoring China's opposition, encroaching on some of the South China Sea islands one after another, and exploiting resources in the South China Sea. In particular, the United States, Japan and other countries intervened under various pretexts. The South China Sea problem is becoming more and more complicated and changeable. How to resolve disputes peacefully and how to find the right balance point between safeguarding national sovereignty interests and maintaining good-neighborly and friendly relations with Southeast Asian countries is a difficult problem facing the Chinese government. This paper discusses the solution of the South China Sea problem. The first part of the introduction to the reasons for the topic of this article, domestic and foreign research situation, research significance and difficulties, research methods and innovation were analyzed; the second part of the South China Sea related issues were analyzed. Furthermore, combining the current situation and current situation of the South China Sea issue, the author draws the conclusion that the South China Sea issue has the dual attribute of law and politics. On this basis, it is proposed that the proper solution of the South China Sea problem should be based on the premise of insisting on the sovereignty of the South China Sea. Then from the legal and political point of view to solve the problem. The third part is to analyze the premise of sovereignty over the South China Sea in accordance with the historical facts and international law to consolidate the legitimacy of this premise. The fourth part clarifies the interests of various countries in the South China Sea from the angle of international politics and lays a foundation for political analysis. The fifth part puts forward how China should solve the South China Sea problem from the angle of law and politics, and finally draws the conclusion that the proper solution of the South China Sea problem requires that the law and political means should be applied in parallel, which is indispensable.
