【摘要】：本文在研究國內(nèi)外現(xiàn)有關(guān)于航運(yùn)市場準(zhǔn)入法律制度的基礎(chǔ)上,綜合運(yùn)用經(jīng)濟(jì)學(xué)、法學(xué)和法經(jīng)濟(jì)學(xué)的基礎(chǔ)理論,借鑒美國和歐盟等航運(yùn)發(fā)達(dá)國家的先進(jìn)立法經(jīng)驗,并采用比較分析、價值分析和歸納演繹等方法,對航運(yùn)市場準(zhǔn)入的基本理論和法律制度要素做了系統(tǒng)、全面和深入的分析。同時,結(jié)合中國具體國情與立法實(shí)踐,對中國航運(yùn)市場準(zhǔn)入立法的健全與完善提出建議,以期建立一套科學(xué)、合理的航運(yùn)市場準(zhǔn)入法律制度,為建立健全航運(yùn)法律體系提供有效的理論依據(jù)與理論支撐。 本文的基本內(nèi)容分為六章： 第1章緒論。確定本文的研究主題。首先,介紹了本文的選題背景,闡釋研究本選題的理論和現(xiàn)實(shí)意義。其次,對國內(nèi)外相關(guān)研究成果進(jìn)行綜述,了解與掌握與航運(yùn)市場準(zhǔn)入相關(guān)的理論發(fā)展脈絡(luò),為下文的分析奠定基礎(chǔ)。再次,明確了研究思路與研究方法。最后,確立了本文研究的基本框架,并闡明創(chuàng)新點(diǎn)。 第2章航運(yùn)市場準(zhǔn)入的基本理論。首先,對航運(yùn)市場準(zhǔn)入的內(nèi)涵與外延進(jìn)行界定,并著重分析航運(yùn)市場準(zhǔn)入的特殊性；其次,運(yùn)用經(jīng)濟(jì)學(xué)的進(jìn)入壁壘和市場理論分析說明航運(yùn)市場準(zhǔn)入應(yīng)當(dāng)受到經(jīng)濟(jì)規(guī)律的調(diào)整；再次,運(yùn)用法學(xué)理論分析說明當(dāng)市場失靈時法律規(guī)則對于航運(yùn)市場準(zhǔn)入的規(guī)范作用；最后,確定法經(jīng)濟(jì)學(xué)原理為本文的主要理論基礎(chǔ),從跨領(lǐng)域、多學(xué)科的視角分析航運(yùn)市場準(zhǔn)入法律制度的構(gòu)建,從而確立了本文的基本理論架構(gòu)。 第3章航運(yùn)市場準(zhǔn)入的法律制度要素。著重分析在政府主導(dǎo)下航運(yùn)市場準(zhǔn)入的制度架構(gòu),以及航運(yùn)企業(yè)與航運(yùn)市場對此的評價,遵循“政府主導(dǎo)——企業(yè)需求——市場調(diào)節(jié)——法律規(guī)制”的主線,闡釋在理論層面航運(yùn)市場準(zhǔn)入的法律制度要素。 第4章國際航運(yùn)市場準(zhǔn)入法律制度。本章著重分析了美國、歐盟等航運(yùn)立法發(fā)達(dá)國家的先進(jìn)立法模式,以及WTO對于航運(yùn)市場準(zhǔn)入的相關(guān)內(nèi)容,歸納總結(jié)出共性規(guī)律以期對我國立法有所借鑒。 第5章當(dāng)前中國航運(yùn)市場準(zhǔn)入法律制度。通過評估當(dāng)前我國航運(yùn)市場準(zhǔn)入的立法現(xiàn)狀,反思當(dāng)前立法中存在的問題,并對產(chǎn)生種種問題的原因進(jìn)行分析總結(jié)。 第6章中國航運(yùn)市場準(zhǔn)入法律制度的完善。在前文理論分析的基礎(chǔ)之上,結(jié)合我困的具體國情,借鑒國際先進(jìn)立法經(jīng)驗,闡釋我國航運(yùn)市場準(zhǔn)入法律制度的基本內(nèi)容,對健全和完善中國航運(yùn)市場準(zhǔn)入法律制度提出建議。
[Abstract]:On the basis of studying the existing legal system of shipping market access at home and abroad, this paper makes comprehensive use of the basic theories of economics, law and law, and draws lessons from the advanced legislative experience of the developed countries such as the United States and the European Union. By means of comparative analysis, value analysis and inductive deduction, this paper makes a systematic, comprehensive and in-depth analysis of the basic theory and legal system elements of shipping market access. At the same time, combined with China's specific national conditions and legislative practice, the paper puts forward some suggestions on the perfection and perfection of China's shipping market access legislation, in order to establish a scientific and reasonable legal system for shipping market access. To establish and improve the legal system of shipping to provide an effective theoretical basis and theoretical support. The basic content of this paper is divided into six chapters: chapter 1 introduction. Determine the research theme of this paper. Firstly, the background of this paper is introduced, and the theoretical and practical significance of the research is explained. Secondly, this paper summarizes the relevant research results at home and abroad, understands and grasps the theoretical development context related to shipping market access, and lays a foundation for the analysis below. Thirdly, it clarifies the research ideas and methods. Finally, the basic framework of this study is established, and the innovation points are clarified. Chapter 2 the basic theory of shipping market access. Firstly, the connotation and extension of shipping market access are defined, and the particularity of shipping market access is analyzed. Thirdly, the legal theory is used to analyze the normative effect of legal rules on shipping market access when the market fails. Finally, the principle of law and economics is the main theoretical basis of this paper. This paper analyzes the construction of legal system of shipping market access from a multi-disciplinary perspective, thus establishing the basic theoretical framework of this paper. Chapter 3 legal system elements of Shipping Market access. Focusing on the analysis of the system structure of shipping market access under the guidance of the government, and the evaluation of shipping enterprises and shipping markets, following the main line of "government-led-enterprise demand-market regulation-legal regulation". Explain the legal system elements of shipping market access at the theoretical level. Chapter 4 legal system of International Shipping Market access. This chapter focuses on the analysis of the advanced legislative models of the developed countries such as the United States and the European Union, as well as the relevant contents of WTO for shipping market access, and sums up the common laws in order to draw lessons from the legislation of our country. Chapter 5 the current legal system of China's shipping market access. By evaluating the current legislation situation of China's shipping market access, this paper reflects on the problems existing in the current legislation, and analyzes and summarizes the causes of these problems. Chapter 6 the perfection of the legal system of China's shipping market access. On the basis of the previous theoretical analysis, combined with the specific situation of our country, and referring to the international advanced legislative experience, this paper explains the basic contents of China's shipping market access legal system, and puts forward some suggestions for perfecting and perfecting China's shipping market access legal system.
