【摘要】：《巴黎協(xié)定》把充分推廣和應(yīng)用綠色技術(shù)作為實(shí)現(xiàn)其目標(biāo)的必要條件,很多發(fā)展中國(guó)家也把促進(jìn)綠色技術(shù)的推廣和應(yīng)用作為能否實(shí)現(xiàn)《巴黎協(xié)定》下自主貢獻(xiàn)目標(biāo)的前提條件。在綠色技術(shù)推廣和應(yīng)用中存在著嚴(yán)重的專利壓制問(wèn)題,導(dǎo)致綠色技術(shù)分布南北失衡,這與《巴黎協(xié)定》要求發(fā)展中國(guó)家在全球溫室氣體減排中扮演重要角色的迫切需求不相符。發(fā)展中國(guó)家要求制定綠色專利強(qiáng)制許可國(guó)際協(xié)議以促進(jìn)綠色技術(shù)的推廣和應(yīng)用。發(fā)達(dá)國(guó)家反對(duì)綠色專利強(qiáng)制許可國(guó)際協(xié)議的理由并不成立,也與《巴黎協(xié)定》的目標(biāo)和要求相沖突。通過(guò)制度設(shè)計(jì)為專利權(quán)人保持利潤(rùn)空間,綠色技術(shù)創(chuàng)新仍然可以保持充分的動(dòng)力.,
[Abstract]:The Paris Agreement regards the full promotion and application of green technology as the necessary condition to achieve its goal, and many developing countries also regard the promotion and application of green technology as the precondition to realize the goal of autonomous contribution under the Paris Agreement. There is a serious problem of patent suppression in the promotion and application of green technology, which leads to the imbalance of the distribution of green technology between the north and the south, which is inconsistent with the urgent need for developing countries to play an important role in reducing greenhouse gas emissions in the world under the Paris Accord. Developing countries require international agreements on compulsory licensing of green patents to promote the promotion and application of green technologies. The reasons why developed countries oppose international agreements on compulsory licensing of green patents do not hold true and conflict with the objectives and requirements of the Paris Agreement. Through institutional design to maintain profit space for the patentee, green technological innovation can still maintain sufficient motivation.
