【摘要】：國際貨運代理行業(yè)是在國際貿易實踐中產生的一個行業(yè),隨著國際貿易的發(fā)展,國際貨運代理行業(yè)也不斷發(fā)展,由傳統(tǒng)上只為委托人代為運輸、報關發(fā)展為可以經營多式聯(lián)運業(yè)務,簽發(fā)自己的提單,由傳統(tǒng)上只作為代理人發(fā)展為可以作為無船承運人、多式聯(lián)運經營人和第三方物流經營人。國際貨運代理人身份的多樣性使得識別它在執(zhí)行某一具體事務中的身份成為了一個難題,而正確認定國際貨運代理人的身份對確定國際貨運代理人的權利、義務、責任又具有重要的意義。 本文分為五個部分： 第一章是國際貨運代理人概述。首先介紹了國際上對國際貨運代理人的定義和國際貨運代理人定義的演變過程,澄清了隨著國際貨運代理人的發(fā)展,現(xiàn)在如果再使用“國際貨運代理人”這一表述可能不十分科學。而后闡明了國際貨運代理人身份識別問題產生的原因和研究此問題的重要意義,結論是探究國際貨運代理人的身份對確定國際貨運代理人的權利、義務、責任具有重要意義。 第二章采用了舉例法和歸納法,試圖通過實際案例來總結判斷國際貨運代理人身份時應當考慮的幾種因素。在第一個案例中,我們可以看到判斷國際貨運代理人并不是簡單的事,要綜合分析多種情況,才能得出正確的結論。在第二個案例中,情況變得更為復雜,國際貨運代理人與他人簽訂的多個合同互相影響,這時不能單獨分析一個合同,而是要綜合分析幾個合同的內容和簽訂過程,弄清楚整個事情的來龍去脈,才能對國際貨運代理人真正的身份做出正確的判斷。 第三章采用了分類討論的方法,在準確識別國際貨運代理人身份之后,分別討論了國際貨運代理人作為代理人和獨立經營人時的權利、義務、責任,作為獨立經營人又可以分為無船承運人、多式聯(lián)運經營人、倉儲保管人、混合經營人。 第四章從一個全新的視角研究了國際貨運代理人作為報關人時的法律地位。具有報關資格的國際貨運代理人可以進行報關業(yè)務,報關一方面是國際貨運代理人代理的事項之一,此時國際貨運代理人與委托人之間是平等主體之間的法律關系,受民法的調整；另一方面,報關是國際貨運代理人向作為國家機關的海關進行申報的活動,此時的國際貨運代理人與海關之間產生的是不平等主體之間的法律關系,受行政、刑事法律的調整。國際貨運代理人在進行這一活動時產生了兩種法律關系,這時國際貨運代理人的法律地位容易產生混淆,法律責任也不甚清晰。所以,識別國際貨運代理人作為報關人時的法律地位具有重要意義。本章就這一問題進行了分情況討論,分別討論了國際貨運代理人與委托人和海關產生關系時的法律地位和法律責任。 第五章為完善國際貨運代理的法律提出建議,試圖對國際貨運代理人概念的澄清、對國際貨運代理人監(jiān)管模式的選擇和監(jiān)管內容的確立和完善提出建議,以期對完善國際貨運代理的法律制度提供參考。
[Abstract]:The international freight forwarding agent industry is an industry in the practice of international trade . With the development of international trade , the international freight forwarding agent industry is developing continuously . It is a problem that the identity of the international freight agent is recognized as a difficult problem in carrying out the identity of the international freight forwarding agent , and it is of great significance to identify the identity of the international freight agent in the determination of the rights , obligations and responsibilities of the international freight agent .


This article is divided into five parts :


Chapter One is an overview of international freight forwarding agents . Firstly , the definition of international freight forwarding agents and the evolution of international freight agent definitions are introduced . As the development of international freight forwarding agents , it may not be very scientific to use the expression of " international freight forwarding agents " .


In the second case , we can see that the international freight forwarder is not a simple matter . Chapter IV studies the legal status of international freight agent as the customs broker from a brand - new perspective . The international freight agent with the declaration of customs clearance can carry on the customs declaration business , the customs declaration is one of the matters of the agent of international freight forwarding agent , at this time , the legal relation between the international freight agent and the principal is equal subject , and is regulated by the civil law ;
On the other hand , the customs declaration is the activity of the international freight forwarding agent to declare to the customs which is the state organ . At this time , the international freight forwarder has two legal relations between the international freight agent and the customs , which is regulated by the administrative and criminal law . The international freight forwarder has two legal relations when carrying out this activity . Therefore , it is very important to identify the legal status of the international freight agent as the customs declaration . Therefore , it discusses the legal status and legal liability of the international freight forwarder in the relationship between the principal and the customs .


In the fifth chapter , we propose to perfect the international freight forwarding agent ' s concept , try to clarify the concept of international freight forwarding agent , make suggestions on the selection of international freight agent supervision mode and the establishment and perfection of supervision content , in order to provide reference for perfecting the legal system of international freight forwarding agent .
