【摘要】：本文主要論述了南中國(guó)海海洋資源權(quán)益爭(zhēng)端與領(lǐng)海爭(zhēng)端的關(guān)系及其實(shí)質(zhì),繼而試圖分析其潛在的原因與國(guó)際法上的解決途徑。 南中國(guó)海問(wèn)題是從20世紀(jì)70年代開(kāi)始,中國(guó)同東南亞一些國(guó)家發(fā)生的關(guān)于海洋資源的爭(zhēng)端,以及島嶼主權(quán)與海洋劃界相關(guān)的領(lǐng)海爭(zhēng)端,它是一個(gè)涉及我國(guó)及其相關(guān)國(guó)家的基本國(guó)家利益并會(huì)一定程度上影響地區(qū)穩(wěn)定的重大問(wèn)題。島嶼主權(quán)與海洋劃界爭(zhēng)端的解決,即領(lǐng)海爭(zhēng)端是海洋資源權(quán)益爭(zhēng)端的最終目的所在。而海洋資源權(quán)益爭(zhēng)端則是領(lǐng)海爭(zhēng)端的實(shí)質(zhì)與關(guān)鍵因素,是解決領(lǐng)海爭(zhēng)端的前站。本文主要從新現(xiàn)實(shí)主義的角度分析中華人民共和國(guó)成立以來(lái),針對(duì)南中國(guó)海諸島海洋資源權(quán)益爭(zhēng)端的實(shí)質(zhì)及原因,即國(guó)際、國(guó)內(nèi)方面的原因,以及對(duì)國(guó)際海洋法上和平解決國(guó)際爭(zhēng)端原則的確認(rèn)、適用和發(fā)展,以及在我國(guó)的對(duì)外交往實(shí)踐中處理與南中國(guó)海周邊國(guó)家有關(guān)海洋資源權(quán)益爭(zhēng)端的方法,力求從中找出若干帶有規(guī)律性的現(xiàn)象加以剖析,并試圖針對(duì)在國(guó)際海洋法、東亞與東南亞國(guó)際體系、南中國(guó)海周邊國(guó)家及中國(guó)方面的原因進(jìn)行探索與分析,來(lái)試圖尋求和平解決南中國(guó)海海洋資源權(quán)益爭(zhēng)端的途徑,從而進(jìn)一步解決南中國(guó)海島嶼主權(quán)與海洋劃界相關(guān)的領(lǐng)土爭(zhēng)端。
[Abstract]:This paper mainly discusses the relationship and essence of the dispute between the rights and interests of marine resources in the South China Sea and the dispute over the territorial sea, and then attempts to analyze its potential causes and the ways to resolve it in international law. The South China Sea issue is a dispute over marine resources between China and some countries in Southeast Asia since the 1970s, as well as a territorial sea dispute over island sovereignty and maritime delimitation. It is a major problem which involves the basic national interests of our country and its related countries and will affect regional stability to some extent. The settlement of the dispute between island sovereignty and maritime delimitation, namely, the territorial sea dispute is the ultimate aim of the dispute on the rights and interests of marine resources. The dispute of rights and interests of marine resources is the essence and key factor of the dispute of territorial sea, and the former station of resolving the dispute of territorial sea. This paper mainly analyzes the essence and causes of the dispute on the rights and interests of the South China Sea islands since the founding of the people's Republic of China from the perspective of neo-realism, that is, the international and domestic reasons. As well as the confirmation, application and development of the principle of peaceful settlement of international disputes in the international law of the sea, as well as the methods of dealing with disputes relating to the rights and interests of marine resources with the countries surrounding the South China Sea in the practice of China's foreign exchanges, It seeks to find out a number of regular phenomena to be analyzed, and tries to explore and analyze the causes of the international law of the sea, the international system of East and Southeast Asia, the neighboring countries of the South China Sea and China. This paper attempts to seek a peaceful solution to the dispute over the rights and interests of marine resources in the South China Sea, thus further resolving the territorial disputes related to the sovereignty of the islands in the South China Sea and maritime delimitation.
