【摘要】：北極公海漁業(yè)問(wèn)題隨著氣候變暖和北冰洋冰雪消融而日益凸顯出重要的戰(zhàn)略價(jià)值。斯瓦爾巴群島的漁業(yè)保護(hù)區(qū)緊鄰北極公海,挪威依據(jù)《斯瓦爾巴條約》在保護(hù)區(qū)行駛管轄權(quán),但締約國(guó)從未正式承認(rèn)挪威管轄權(quán)的合法性,北極公海漁業(yè)資源的戰(zhàn)略價(jià)值必將再次引發(fā)締約國(guó)對(duì)斯島漁業(yè)保護(hù)區(qū)特殊性與合法性的爭(zhēng)論與博弈。作為《聯(lián)合國(guó)海洋公約》與《斯約》締約國(guó),中國(guó)應(yīng)積極參與北極公海及斯島漁業(yè)規(guī)則的制定進(jìn)程,倡導(dǎo)在生態(tài)保護(hù)合作原則和預(yù)防性原則基礎(chǔ)上,制定北極公海區(qū)域或次區(qū)域漁業(yè)管理規(guī)則,加強(qiáng)中國(guó)在北極公海與斯島漁業(yè)保護(hù)區(qū)捕魚(yú)權(quán)的雙向互動(dòng),以此為突破口深度介入北極地區(qū)性、領(lǐng)域化的制度設(shè)計(jì)。
[Abstract]:The problem of Arctic high seas fishery is becoming more and more important with the warming of climate and the melting of Arctic ice and snow. The Svalbard Islands fisheries reserve is adjacent to the Arctic high seas and Norway exercises jurisdiction in the protected area under the Treaty of Svalbard, but the States parties have never officially recognized the legality of Norwegian jurisdiction, The strategic value of the high seas fishery resources in the Arctic will lead to the controversy and game between the States parties on the particularity and legality of the fisheries reserve in Sri Lanka. As a signatory to the United Nations Convention on the Law of the Sea and the Treaty, China should take an active part in the process of formulating the fisheries rules for the Arctic high seas and islands, and promote the principles of cooperation in ecological protection and the precautionary principle. To establish the rules of fisheries management in the high seas of the Arctic and to strengthen the two-way interaction between China's fishing rights in the high seas of the Arctic and the fisheries protection area of Sri Lanka, and to take this as the breakthrough point to deeply intervene in the regional and territorial system design of the Arctic.
