【摘要】：職務(wù)犯罪越來越趨于智能化、專業(yè)化、現(xiàn)代化,傳統(tǒng)的偵查手段和措施已經(jīng)難以適應(yīng)當(dāng)前職務(wù)犯罪偵查工作的需要。使用特殊偵查措施偵破案件,是當(dāng)前查辦職務(wù)犯罪案件必不可少的手段。 我國(guó)目前已有部門法規(guī)定了一些關(guān)于技術(shù)偵查措施的適用,新的刑事訴訟法修正案也專門制定了“技術(shù)偵查措施”一章,但是規(guī)定的不全面,不具體,對(duì)其他特殊偵查措施也沒有規(guī)定。任何法律制度的建立,都需要一個(gè)自我完善的的過程,本文運(yùn)用實(shí)證分析、比較分析等研究方法,針對(duì)該制度目前存在的種種缺陷,結(jié)合已有的理論研究成果,分析和探討如何克服這些缺陷,提出了一些改革的構(gòu)想和建議,并對(duì)如何防止特殊偵查措施過度使用和保護(hù)人權(quán)制度做初步探討。 全文除引言和結(jié)束語(yǔ)外,正文分為四章。第一章為職務(wù)犯罪特殊偵查措施的概念、特點(diǎn)和種類。對(duì)偵查措施和職務(wù)犯罪偵查措施的內(nèi)涵、本質(zhì)以及特點(diǎn)作了簡(jiǎn)要分析,第二章為職務(wù)犯罪偵查中運(yùn)用特殊偵查措施的必要性。對(duì)職務(wù)犯罪偵查的特殊性,國(guó)際公約的規(guī)定,和我國(guó)當(dāng)前職務(wù)犯罪的形勢(shì)做一定分析,從而闡述了在職務(wù)犯罪特殊偵查中運(yùn)用特殊偵查措施的必要性。第三章為國(guó)內(nèi)外特殊偵查措施立法現(xiàn)狀。我國(guó)現(xiàn)行特殊偵查措施的立法相對(duì)落后,新刑事訴訟法修正案對(duì)技術(shù)偵查措施的規(guī)定也存在缺陷,本章著重介紹了外國(guó)有關(guān)特殊偵查措施的立法模式及基本內(nèi)容,并進(jìn)行了簡(jiǎn)要分析。第四章為構(gòu)建職務(wù)犯罪特殊偵查制度的立法完善和構(gòu)想。本章首先對(duì)一些與職務(wù)犯罪特殊偵查措施相關(guān)的傳統(tǒng)觀念及理論問題進(jìn)行了反思與論證,繼而對(duì)構(gòu)建職務(wù)犯罪特殊偵查措施的基本原則、種類,特殊偵查措施的程序規(guī)制和人權(quán)保障等問題提出了構(gòu)想。
[Abstract]:The duty crime is becoming more and more intelligent, specialized, modernized, and the traditional investigation methods and measures have been difficult to meet the needs of the present duty crime investigation. The use of special investigative measures to solve cases is an essential means to investigate and handle crimes committed by duty. At present, there are some departmental laws on the application of technical investigation measures in our country. The new amendment to the Criminal procedure Law also contains a special chapter on "Technical investigation measures," but the provisions are not comprehensive and specific. There is also no provision for other special investigative measures. The establishment of any legal system needs a self-improvement process. This paper uses empirical analysis, comparative analysis and other research methods, in view of the existing defects of the system, combined with the existing theoretical research results. This paper analyzes and discusses how to overcome these shortcomings, puts forward some ideas and suggestions for reform, and makes a preliminary discussion on how to prevent the excessive use of special investigative measures and the system of protecting human rights. In addition to the introduction and concluding remarks, the text is divided into four chapters. The first chapter is the concept, characteristics and types of special investigation measures of duty crime. This paper makes a brief analysis of the connotation, essence and characteristics of the investigative measures of investigation and duty crime. The second chapter is the necessity of applying special investigative measures in the investigation of job-related crimes. This paper analyzes the particularity of duty crime investigation, the provisions of international conventions and the current situation of duty crime in China, and expounds the necessity of applying special investigation measures in duty crime investigation. The third chapter is the domestic and foreign special investigation measure legislation present situation. The current legislation of special investigative measures in China is relatively backward, and the new amendment of criminal procedure law also has defects in the provisions of technical investigative measures. This chapter emphatically introduces the legislative model and basic contents of foreign special investigative measures. A brief analysis is made. The fourth chapter is the legislative perfection and conception of constructing the special investigation system of duty crime. This chapter first reflects on and demonstrates some traditional concepts and theoretical problems related to the special investigation measures of job-related crimes, and then discusses the basic principles and types of the construction of special investigative measures for job-related crimes. This paper puts forward some ideas about the procedural regulation and human rights protection of special investigation measures.
