【摘要】："加百利"輪案在中國海事司法歷史上具有重要的開拓意義。從法理上講,該案解決了國際條約在法律體系中的法律地位問題,界定了雇傭救助合同,運(yùn)用特別法與一般法的關(guān)系確定救助報(bào)酬。審視其訴訟構(gòu)成特別是再審過程中超強(qiáng)的審判團(tuán)隊(duì)、自信的當(dāng)庭宣判、空前的司法公開程度等要素,該案成為典型案件的自身稟賦極高。從該案的典型性出發(fā),今后最高法院可以考慮類似案件安排法官觀摩庭審;逐步放棄案多取勝模式,切實(shí)走精品案例戰(zhàn)略;切實(shí)加強(qiáng)典型案例研究;探索最高法院數(shù)位大法官或全部大法官一起開庭機(jī)制。
[Abstract]:The Gabriel case is of great significance in the maritime judicial history of China. From the legal point of view, the case solves the legal status of international treaties in the legal system, defines the employment salvage contract, and uses the relationship between special law and general law to determine the compensation for relief. Examining the composition of its litigation, especially the super-strong trial team in the process of retrial, the confident judgment in court and the unprecedented degree of judicial openness, this case has become a typical case of its own very high endowment. Starting from the typicality of the case, the Supreme Court may consider arranging the judges to observe the court hearing in similar cases in the future, gradually abandon the multi-win mode of the case, take the high-quality case strategy, and strengthen the typical case study. Explore the mechanism by which several or all Supreme Court justices sit together.
