【摘要】：WTO自1995年成立以來(lái),其爭(zhēng)端解決機(jī)制在處理國(guó)際經(jīng)貿(mào)糾紛方面發(fā)揮著日益重要的作用,這是有目共睹的。但是,我們?nèi)匀徊荒苷f(shuō)WTO爭(zhēng)端解決機(jī)制是完善而成熟的,許多成員方都對(duì)它提出了批評(píng)意見(jiàn)。對(duì)WTO爭(zhēng)端解決機(jī)制進(jìn)行修改的談判由來(lái)已久,但是多年未果。在2004年5月28日的一次特會(huì)上,各成員方一致認(rèn)為,對(duì)DSU進(jìn)行修改的談判仍然需要更多的時(shí)間。如今,國(guó)際社會(huì)對(duì)爭(zhēng)端解決機(jī)制進(jìn)行修改的談判日益關(guān)注,在這個(gè)背景下,對(duì)爭(zhēng)端解決機(jī)制的缺陷和問(wèn)題進(jìn)行研究和闡釋是十分緊迫和必要的。 爭(zhēng)端解決機(jī)制被認(rèn)為是以規(guī)則為導(dǎo)向的WTO體系的最重要的支柱。WTO爭(zhēng)端解決機(jī)制在一定程度上增加了爭(zhēng)端解決的效率和可預(yù)見(jiàn)性,但它對(duì)發(fā)展中國(guó)家的實(shí)際作用遠(yuǎn)低于原先的設(shè)想,不能被發(fā)展中國(guó)家公平、有效地利用,在某些方面甚至對(duì)發(fā)展中國(guó)家的利益不利,因此,亟需進(jìn)一步的改進(jìn)。由于成員各方利益的沖突和技術(shù)方面的原因,目前對(duì)爭(zhēng)端解決機(jī)制的改革進(jìn)程并不順利,實(shí)現(xiàn)使WTO爭(zhēng)端解決機(jī)制更加公平合理的改革目標(biāo)尚需發(fā)展中國(guó)家的共同努力。 研究WTO爭(zhēng)端解決機(jī)制,包括如磋商程序問(wèn)題、專(zhuān)家組程序問(wèn)題、上訴機(jī)構(gòu)的職權(quán)等問(wèn)題。爭(zhēng)議雙方提請(qǐng)WTO爭(zhēng)端解決機(jī)制解決爭(zhēng)議,及專(zhuān)家組與上訴機(jī)構(gòu)用于解決爭(zhēng)端的法律淵源有哪些,對(duì)當(dāng)事方而言意義重大,往往決定了爭(zhēng)議的最后結(jié)果。 為了可以公平、有效地利用這一機(jī)制,我國(guó)除了需要加強(qiáng)自己法律隊(duì)伍的建設(shè),聯(lián)合力量建立區(qū)域性機(jī)構(gòu),合作解決人才問(wèn)題,還應(yīng)該積極向理事會(huì)提出改進(jìn)WTO爭(zhēng)端解決機(jī)制的要求的議案,以維護(hù)自身的正當(dāng)利益。也為我國(guó)能主動(dòng)參與定制國(guó)際貿(mào)易規(guī)則,得到一個(gè)大國(guó)所應(yīng)有的國(guó)際發(fā)言權(quán)搭建了一個(gè)堅(jiān)實(shí)的平臺(tái)。 綜上所述,本文試圖通過(guò)對(duì)WTO爭(zhēng)端解決機(jī)制的由來(lái)、特點(diǎn)及不足之處的論述,以及介紹WTO各成員方對(duì)爭(zhēng)端解決機(jī)制改革所提出的建議,就中國(guó)如何更好地應(yīng)對(duì)WTO爭(zhēng)端機(jī)制改革進(jìn)行一些研究,希望能從中得到一些有益的啟示。
[Abstract]:Since the establishment of WTO in 1995, its dispute settlement mechanism has played an increasingly important role in dealing with international economic and trade disputes, which is obvious to all. However, we still can not say that the WTO dispute settlement mechanism is perfect and mature, and many members have criticized it. The WTO dispute settlement mechanism has been revised for a long time, but failed for many years. At a special meeting on May 28, 2004, members agreed that more time was needed to negotiate changes to the DSU. Today, the international community is paying more and more attention to the negotiations on the revision of the dispute settlement mechanism. In this context, It is very urgent and necessary to study and explain the defects and problems of the dispute settlement mechanism. The dispute settlement mechanism is considered to be the most important pillar of the rules-based WTO system.WTO dispute settlement mechanism to a certain extent Increasing the efficiency and predictability of dispute settlement, However, its practical role for developing countries is far less than originally envisaged, and it cannot be used equitably and efficiently by developing countries, and in some respects it is even detrimental to the interests of developing countries. Therefore, further improvement is urgently needed. The current process of reform of the dispute settlement mechanism has not been smooth owing to conflicts of interest and technical reasons among the members, To realize the reform goal of making WTO dispute settlement mechanism more equitable and reasonable, it is necessary for developing countries to make joint efforts, and to study WTO dispute settlement mechanism, including such issues as consultation procedure, panel procedure and the authority of the appellate body, etc. The parties to the dispute request the dispute settlement mechanism of the WTO, and the sources of law used by the panel and the appellate body to settle the dispute, which are of great significance to the parties and often determine the final outcome of the dispute. In order to be fair, In order to make effective use of this mechanism, apart from strengthening the construction of our own legal contingent, establishing regional organizations and cooperating in solving the problem of talents, our country should actively propose to the Council a bill to improve the WTO dispute settlement mechanism. To defend one's own legitimate interests. It also provides a solid platform for China to actively participate in the customization of international trade rules and get the international voice due to a great power. In summary, this paper attempts to analyze the origin of the WTO dispute settlement mechanism. This paper discusses the characteristics and inadequacies, introduces the suggestions made by WTO members on the reform of the dispute settlement mechanism, and makes some studies on how China can better deal with the reform of the dispute settlement mechanism of WTO, hoping to get some useful enlightenment from it.
