【摘要】：健康對人的生存發(fā)展至關(guān)重要。本文通過對健康權(quán)概念、內(nèi)容的闡述以及與國際上健康權(quán)法律保護(hù)的比較,指出當(dāng)前我國公民健康權(quán)法律保護(hù)存在的問題,并提出了相關(guān)建議。本文共六章。第一章緒論對本文的背景意義、研究方法、創(chuàng)新點(diǎn)進(jìn)行了闡述。第二章通過對各種說法的列舉比較,具體闡述了健康的概念和健康權(quán)的概念、內(nèi)容,以及與部分基本人權(quán)的比較。第三章論述了國際層面健康權(quán)的法律保護(hù)。第四章論述了我國健康權(quán)法律保護(hù)的現(xiàn)狀,并提出我國健康權(quán)保護(hù)存在的問題。第五章針對我國健康權(quán)保護(hù)存在的問題,從完善立法、具體制度構(gòu)建和完善法律救濟(jì)方式三個(gè)方面提出了我國健康權(quán)法律保護(hù)制度的基本設(shè)想。第六章對整個(gè)論文進(jìn)行了總結(jié),提出結(jié)論。本文一是通過對各家學(xué)說的比較,提出了自己的健康權(quán)概念,豐富了健康權(quán)的內(nèi)容,并界定了健康權(quán)的性質(zhì)。二是對健康權(quán)法律保護(hù)歷史沿革以及國際上健康權(quán)保護(hù)的現(xiàn)狀的分析比較,找出了當(dāng)前我國健康權(quán)法律保護(hù)存在的問題,并有針對性地提出了解決辦法。三是對于當(dāng)前醫(yī)療改革問題涉及的一個(gè)基礎(chǔ)問題——健康權(quán)做了一個(gè)基礎(chǔ)的理論探討,為醫(yī)療改革界定了一個(gè)方向。
[Abstract]:Health is vital to the survival and development of human beings. This paper points out the problems existing in the legal protection of the right to health of Chinese citizens at present and puts forward some relevant suggestions through the elaboration of the concept and content of the right to health and the comparison with the legal protection of the right to health in the world. There are six chapters in this paper. The first chapter introduces the background significance, research method and innovation of this paper. The second chapter elaborates the concept of health and the concept of the right to health, as well as the comparison with some basic human rights through the enumeration and comparison of various statements. The third chapter discusses the legal protection of the right to health at the international level. The fourth chapter discusses the current situation of legal protection of the right to health in China, and points out the existing problems in the protection of the right to health in China. In the fifth chapter, aiming at the problems existing in the protection of the right to health in China, the author puts forward the basic ideas of the legal protection system of the right to health in China from three aspects: perfecting the legislation, constructing the concrete system and perfecting the way of legal remedy. The sixth chapter summarizes the whole paper and puts forward the conclusion. First, through the comparison of various theories, the author puts forward his own concept of right to health, enriches the content of right to health, and defines the nature of right to health. The second is to analyze and compare the history of the legal protection of the right to health and the current situation of the protection of the right to health in the world, and to find out the problems existing in the legal protection of the right to health in our country, and to put forward the corresponding solutions. The third is to make a theoretical discussion on the basic problem of the current health care reform-the right to health, and to define a direction for the medical reform.
