【摘要】：自WTO成立以來(lái),其爭(zhēng)端解決機(jī)制在解決國(guó)際貿(mào)易爭(zhēng)端領(lǐng)域內(nèi)發(fā)揮了巨大的作用,尤其是其中的專家組程序作為爭(zhēng)端解決的第一層權(quán)力機(jī)構(gòu),贏得了越來(lái)越多的信賴與尊重。本文從介紹專家組程序的基本理論出發(fā),分析了專家組程序的準(zhǔn)司法性特征,對(duì)專家組程序的性質(zhì)作出界定,并概括專家組程序?qū)ATT的發(fā)展和突破。但是專家組程序并不是完美無(wú)缺的,它在實(shí)際運(yùn)作中也暴露出來(lái)一些問(wèn)題和缺陷。本文探討了專家組程序中的幾個(gè)熱點(diǎn)問(wèn)題,如專家組組成問(wèn)題,期間評(píng)審程序目的的落空,舉證責(zé)任的混亂及“初步事實(shí)”理論的應(yīng)用,以及透明度問(wèn)題產(chǎn)生的爭(zhēng)議等。本文從幾個(gè)方面切入,對(duì)專家組程序運(yùn)作過(guò)程中暴露出的上述不足提出自己的改革建議,如探討了常設(shè)專家組設(shè)想的可能性,并提出一種新的專家組指示性名單選擇標(biāo)準(zhǔn)；專家組程序中的“第三方”制度,肯定了第三方制度在專家組程序中積極意義,并探討了第三方權(quán)利擴(kuò)大的范圍和限制。最后,本文聯(lián)系我國(guó)在專家組程序中的實(shí)踐,對(duì)其進(jìn)行評(píng)析并得到啟示,同時(shí)概括了中國(guó)在WTO改革談判中的提議,并對(duì)中國(guó)如何應(yīng)對(duì)WTO專家組程序提出了對(duì)策和建議。
[Abstract]:Since the establishment of WTO, its dispute settlement mechanism has played a great role in the field of settlement of international trade disputes, especially the panel procedure, as the first layer of authority of dispute settlement, has won more and more trust and respect. Based on the introduction of the basic theory of expert group procedure, this paper analyzes the quasi-judicial characteristics of expert group procedure, defines the nature of expert group procedure, and generalizes the development and breakthrough of expert group procedure to GATT. But the expert group procedure is not perfect, it also exposes some problems and defects in actual operation. This paper discusses several hot issues in the panel procedure, such as the composition of the panel of experts, the failure of the purpose of the evaluation procedure during the review process, the confusion of the burden of proof and the application of the theory of "preliminary facts", as well as the controversy arising from the issue of transparency. From several aspects, this paper puts forward some reform proposals for the above deficiencies in the course of the expert group procedure, such as exploring the possibility of the permanent expert group, and putting forward a new criteria for the selection of the indicative list of the expert group. The "third party" system in the expert group procedure affirms the positive significance of the third party system in the panel procedure, and probes into the scope and limitation of the expansion of the third party right. Finally, this paper reviews and enlightens China's practice in panel procedure, summarizes China's proposals in WTO reform negotiations, and puts forward some countermeasures and suggestions on how China should deal with WTO panel procedure.
