海洋經(jīng)濟(jì)時(shí)代下新興造船業(yè)主體法律問(wèn)題研究

【摘要】:適逢國(guó)務(wù)院正式批復(fù)《浙江海洋經(jīng)濟(jì)發(fā)展示范區(qū)規(guī)劃》并決定在溫州市設(shè)立金融綜合改革實(shí)驗(yàn)區(qū),這為我國(guó)新興造船業(yè)的發(fā)展提供了機(jī)遇。于此同時(shí),國(guó)際海事組織相繼出臺(tái)的造船新標(biāo)準(zhǔn)也給我國(guó)技術(shù)環(huán)節(jié)相對(duì)薄弱的造船業(yè)帶來(lái)了不小的沖擊。筆者深入新興造船業(yè)的典型代表地區(qū)臺(tái)州調(diào)研,了解到當(dāng)前造船掛靠現(xiàn)象在臺(tái)州地區(qū)非常普遍,本文意從法律層面為我國(guó)的造船業(yè)發(fā)展提供些許意見(jiàn)與建議,為我國(guó)從造船大國(guó)邁向造船強(qiáng)國(guó)提供法律保障。 本學(xué)位論文由引言、正文和結(jié)語(yǔ)三大部分構(gòu)成。文章引言部分結(jié)合當(dāng)下發(fā)展海洋經(jīng)濟(jì)的國(guó)際國(guó)內(nèi)大背景,簡(jiǎn)述我國(guó)新興造船業(yè)發(fā)展的社會(huì)環(huán)境。正文通過(guò)五個(gè)部分對(duì)海洋經(jīng)濟(jì)時(shí)代下新興造船業(yè)主體法律問(wèn)題進(jìn)行研究。 正文第一部分是“海洋經(jīng)濟(jì)時(shí)代下新興造船業(yè)發(fā)展現(xiàn)狀”,筆者在該部分主要闡述我國(guó)造船業(yè)發(fā)展的歷史軌跡,迎來(lái)了機(jī)遇與挑戰(zhàn)并存的新興造船業(yè)發(fā)展時(shí)代,并以浙江省臺(tái)州地區(qū)為典型闡述其發(fā)展新興造船業(yè)的優(yōu)劣勢(shì)。文章第二部分是“海洋經(jīng)濟(jì)時(shí)代下臺(tái)州新興造船業(yè)主體方面的特點(diǎn)”,筆者在該部分針對(duì)造船主體特點(diǎn)問(wèn)題,側(cè)重從理論和實(shí)踐上論述現(xiàn)實(shí)生活中屢見(jiàn)不鮮的造船掛靠現(xiàn)象。文章第三部分是“新興造船業(yè)主體各方的法律問(wèn)題”,這一部分為重點(diǎn)部分,筆者在該部分主要論述造船主體中船廠與船東兩方的權(quán)利義務(wù)關(guān)系問(wèn)題,并結(jié)合近年來(lái)發(fā)生的典型案例具體闡述其法律地位和責(zé)任承擔(dān)相關(guān)法律制度。文章第四部分是“新興造船業(yè)主體面臨的國(guó)際新形勢(shì)”,在該部分筆者以低碳經(jīng)濟(jì)下船舶減排為切入點(diǎn),列舉大量造船業(yè)國(guó)際標(biāo)準(zhǔn)、、國(guó)內(nèi)標(biāo)準(zhǔn)及國(guó)際上各方對(duì)船舶減排統(tǒng)一標(biāo)準(zhǔn)制定的態(tài)度,明確提出我國(guó)引導(dǎo)造船主體建造綠色船舶的未來(lái)方向。文章第五部分是“海洋經(jīng)濟(jì)時(shí)代下我國(guó)造船業(yè)主體的應(yīng)對(duì)對(duì)策”,在該部分筆者結(jié)合我國(guó)造船業(yè)發(fā)展的實(shí)際情況從我國(guó)政府及造船主體兩個(gè)角度就中國(guó)構(gòu)建造船業(yè)相關(guān)法律制度提出若干建議。 文章結(jié)語(yǔ)部分在縱觀國(guó)際國(guó)內(nèi)社會(huì)造船業(yè)發(fā)展形勢(shì)的基礎(chǔ)上,強(qiáng)調(diào)順應(yīng)時(shí)代潮流,從完善法律制度和加強(qiáng)技術(shù)革新兩個(gè)著力點(diǎn)出發(fā)完成我國(guó)從造船大國(guó)到造船強(qiáng)國(guó)的華麗轉(zhuǎn)身。 本論文的創(chuàng)新點(diǎn)體現(xiàn)在:第一,目前我國(guó)研究造船過(guò)程中出現(xiàn)的法律問(wèn)題的成果為數(shù)不多,且在探討船舶掛靠相關(guān)問(wèn)題時(shí),國(guó)內(nèi)大多數(shù)文獻(xiàn)都將目光投向船舶營(yíng)運(yùn)時(shí)的掛靠問(wèn)題,對(duì)造船掛靠的研究具有獨(dú)創(chuàng)性。第二,在我國(guó)造船業(yè)面臨重大機(jī)遇與挑戰(zhàn)并存的新形勢(shì)下選取典型案例進(jìn)行深入分析具有新穎性。第三,在中國(guó)發(fā)展海洋經(jīng)濟(jì)、船舶工業(yè)十二五規(guī)劃明確提出從造船大國(guó)走向造船強(qiáng)國(guó)、低碳浪潮呼喚綠色船舶的大背景下,探索構(gòu)建中國(guó)新興造船業(yè)相關(guān)法律制度,具有前瞻性。
[Abstract]:On the occasion of the State Council's formal approval of "Zhejiang Marine Economic Development demonstration Zone Plan" and the decision to set up a financial comprehensive reform experimental area in Wenzhou City, this provides an opportunity for the development of China's new shipbuilding industry. At the same time, the new shipbuilding standards issued by the International Maritime Organization (IMO) have also brought great impact to the shipbuilding industry, which has relatively weak technical links. The author goes deep into Taizhou, a typical representative area of new shipbuilding industry, and finds out that the shipbuilding link is very common in Taizhou area. This paper intends to provide some advice and suggestions for the development of shipbuilding industry in our country from the legal level. This thesis consists of three parts: introduction, text and conclusion. In the introduction part, the social environment of the development of new shipbuilding industry in China is briefly described in combination with the international and domestic background of the current development of marine economy. The first part of the text is "the present situation of the new shipbuilding industry in the era of marine economy", the first part of the text is "the current situation of the new shipbuilding industry in the era of marine economy". In this part, the author mainly expounds the historical track of the development of China's shipbuilding industry, ushered in a new shipbuilding industry with both opportunities and challenges, and took Taizhou area of Zhejiang Province as a typical example to explain the advantages and disadvantages of the development of the new shipbuilding industry. The second part of the article is "the characteristics of the main body of Taizhou's new shipbuilding industry in the era of marine economy". In this part, the author focuses on the characteristics of the shipbuilding subject and discusses in theory and practice the common phenomenon of shipbuilding in real life. The third part of the article is "the legal problems of the main parties of the new shipbuilding industry", this part is the key part. In this part, the author mainly discusses the relationship between the shipyards and the shipowners' rights and obligations. Combined with the typical cases in recent years, the legal status and responsibility of the relevant legal system. The fourth part of the article is "the new international situation facing the main body of the new shipbuilding industry". In this part, the author regards the emission reduction of the ship under the low carbon economy as the breakthrough point. This paper enumerates a large number of international standards for shipbuilding industry, domestic standards and international attitudes towards the unified standards for reducing emissions of ships, and points out the future direction of guiding shipbuilding agents to build green ships in China. The fifth part of the article is "the countermeasures of the main body of shipbuilding industry in our country in the era of marine economy". In this part, the author puts forward some suggestions on how to construct the legal system of shipbuilding industry in China from the angle of our government and shipbuilding subject, combining with the actual situation of the development of shipbuilding industry in China. The conclusion of this article is to make a general survey of the international and domestic society. On the basis of the development situation of the shipbuilding industry, Emphasis is placed on following the trend of the times, starting from the two main points of perfecting the legal system and strengthening the technological innovation, to complete the magnificent turn of our country from a large shipbuilding country to a shipbuilding power. The innovations of this paper are as follows: first, At present, there are few achievements in the study of legal problems in the process of shipbuilding in our country, and when discussing the related problems of ship alignment, most of the domestic literatures have turned their attention to the problem of ship alignment in the course of ship operation. The research on shipbuilding alignment is original. Secondly, in the new situation where the shipbuilding industry is faced with both opportunities and challenges, it is new to select typical cases for in-depth analysis. Third, under the background of the development of marine economy in China, the 12th Five-Year Plan of Shipbuilding Industry clearly proposes to move from a large shipbuilding country to a shipbuilding power, and the low carbon wave calls for green ships, this paper explores and constructs the relevant legal system of China's new shipbuilding industry.
