【摘要】：文章在對萬民法內(nèi)涵與特征分析的基礎(chǔ)上,深入剖析區(qū)域性貿(mào)易活動與萬民法的發(fā)展進程的互動—廣泛存在的貿(mào)易活動為立法提供了充分的需求空間和實踐基礎(chǔ),而沿承了自然法精神的萬民法為當(dāng)時特定區(qū)域—羅馬帝國征服城邦(地域)之間的區(qū)域性貿(mào)易活動的進一步繁榮提供了強大的理論支持和制度保障。在此基礎(chǔ)上,萬民法體系內(nèi)的法律概念的界定、法律精神的詮釋,治理模式的選擇與尊崇等都對國際法的產(chǎn)生與發(fā)展產(chǎn)生了深遠(yuǎn)的影響,并對當(dāng)前國際法學(xué)研究具有重要指導(dǎo)價值。
[Abstract]:Based on the analysis of the connotation and characteristics of the law of the people, the paper analyzes the interaction between the regional trade activities and the development process of the law of the people. The extensive trade activities provide sufficient demand space and practical basis for the legislation. The law of peoples along the spirit of natural law provided a strong theoretical support and institutional guarantee for the further prosperity of regional trade activities between the specific regions of the Roman Empire and the conquest of the city-states (regions) at that time. On this basis, the definition of the legal concept, the interpretation of the legal spirit, the choice and respect of the governance model have exerted a profound influence on the emergence and development of international law. And it has important guiding value to the current international legal research.
