【摘要】：深海是21世紀(jì)的新疆域。一個完善的深海資源開發(fā)投資制度,是投資者和深海采礦業(yè)的福音,必將促進(jìn)私人投資者在深海海底區(qū)域資源勘探開發(fā)中發(fā)揮主體作用。《聯(lián)合國海洋法公約》第十一部分確立的國際海底區(qū)域開發(fā)制度并沒有顧及私人投資者參與深海資源開發(fā)的特殊需要,而現(xiàn)行的國際投資法制也不能滿足國際海底區(qū)域這個特殊的疆域的投資對制度的需求。一個各海洋大國深海海底資源商業(yè)性開發(fā)的時代即將來臨,它呼喚一個旨在促進(jìn)和保護(hù)深海資源開發(fā)投資的制度。
[Abstract]:The deep sea is the new territory of the 21 st century. A sound investment system for deep-sea resource development is a boon for investors and deep-sea mining. The international seabed area development regime established in part XI of the United Nations Convention on the Law of the Sea does not take into account the deep participation of private investors in the exploration and exploitation of resources in the deep seabed area. Special needs for the development of marine resources, The current international investment law can not meet the needs of the international seabed area. An era of commercial exploitation of deep-sea seabed resources is coming, which calls for a system to promote and protect investment in deep-sea resources development.
