【摘要】：農(nóng)業(yè)是人類(lèi)生存和發(fā)展的最為基本的產(chǎn)業(yè),是國(guó)民經(jīng)濟(jì)的基礎(chǔ),是我們?nèi)祟?lèi)生存中物質(zhì)資料的主要來(lái)源。農(nóng)業(yè)的發(fā)展程度直接決定著一個(gè)國(guó)家和地區(qū)社會(huì)經(jīng)濟(jì)的穩(wěn)定。但是由于農(nóng)業(yè)自身所具有的特性,僅僅依靠其自身的積累很難會(huì)得到有效地發(fā)展。所以,世界范圍內(nèi)各個(gè)國(guó)家和地區(qū)都普遍實(shí)施支持和保護(hù)農(nóng)業(yè)的政策。我國(guó)加入了WTO,這就要求我國(guó)的相關(guān)政策應(yīng)該符合其規(guī)定,農(nóng)業(yè)補(bǔ)貼制度也包括在內(nèi)。我國(guó)的農(nóng)業(yè)補(bǔ)貼法律制度相較以前已經(jīng)有了很大的改善,但是與WTO下的《農(nóng)業(yè)協(xié)定》相比還有很多不足之處。怎樣在WTO下《農(nóng)業(yè)協(xié)定》范圍內(nèi)建構(gòu)和完善我國(guó)的農(nóng)業(yè)補(bǔ)貼法律制度具有非常重要的意義。 本文在現(xiàn)有理論研究成果和國(guó)內(nèi)外實(shí)踐的基礎(chǔ)上,對(duì)農(nóng)業(yè)補(bǔ)貼的法律制度進(jìn)行了相應(yīng)的研究。除了引言和結(jié)論外,全文約3萬(wàn)字,主要有三大部分： 第一部分講述了農(nóng)業(yè)補(bǔ)貼法律制度的法理基礎(chǔ),重點(diǎn)闡述了農(nóng)業(yè)補(bǔ)貼的概念、意義以及WTO《農(nóng)業(yè)協(xié)議》中有關(guān)農(nóng)業(yè)補(bǔ)貼法律制度的主要內(nèi)容。這一部分是本文研究的基礎(chǔ)。 第二部分對(duì)我國(guó)的農(nóng)業(yè)補(bǔ)貼立法及實(shí)施現(xiàn)狀進(jìn)行了分析,并以《農(nóng)業(yè)協(xié)議》為標(biāo)準(zhǔn)提出了我國(guó)農(nóng)業(yè)補(bǔ)貼立法上的缺失與實(shí)施上的不足,主要是從黃箱、綠箱以及藍(lán)箱這三方面進(jìn)行闡述。這一部分為第三部分的完善建議提供了依據(jù)。 第三部分是本文的重點(diǎn),根據(jù)第二部分提出的問(wèn)題闡述了完善我國(guó)農(nóng)業(yè)補(bǔ)貼法律制度的建議和措施。首先是立法上的完善,包括完善的目標(biāo)和原則以及立法規(guī)定等。其次是對(duì)農(nóng)業(yè)補(bǔ)貼具體法律制度進(jìn)行設(shè)計(jì),其是圍繞黃箱、綠箱和藍(lán)箱這三方面進(jìn)行具體分析的。
[Abstract]:Agriculture is the most basic industry for human survival and development, the basis of the national economy, and the main source of material data in our human existence. The development of agriculture directly determines the social and economic stability of a country and region. However, due to the characteristics of agriculture itself, it is difficult to develop effectively by its own accumulation. Therefore, countries and regions all over the world generally implement policies to support and protect agriculture. China has joined WTO, which requires that the relevant policies of our country should conform to its regulations, and the agricultural subsidy system should also be included. The legal system of agricultural subsidy in our country has been greatly improved compared with the previous one, but there are still many deficiencies compared with the Agriculture Agreement under WTO. How to construct and perfect the legal system of agricultural subsidy under WTO is of great significance. Based on the existing theoretical research results and domestic and foreign practice, this paper studies the legal system of agricultural subsidies. In addition to the introduction and conclusions, the full text is about 30,000 words, with three main parts: The first part describes the legal basis of the legal system of agricultural subsidies, focusing on the concept and significance of agricultural subsidies, as well as the main contents of the legal system of agricultural subsidies in WTO. This part is the basis of this study. The second part analyzes the current situation of agricultural subsidy legislation and implementation in our country, and puts forward the deficiency and deficiency of agricultural subsidy legislation in our country according to the agricultural agreement, mainly from the yellow box. Green box and blue box these three aspects to elaborate. This part provides the basis for the improvement of the third part. The third part is the focus of this paper, according to the second part of the problems put forward to improve the legal system of agricultural subsidies in China's recommendations and measures. The first is the perfection of legislation, including the goal and principle of perfection, as well as legislative provisions. The second is the design of the specific legal system of agricultural subsidy, which focuses on the yellow box, green box and blue box.
