【摘要】:數(shù)據(jù)外包業(yè)務(wù)是我國國際服務(wù)外包的重要組成部分,是提高我國外包層次和競爭水平的機(jī)會所在。數(shù)據(jù)外包業(yè)務(wù)包括大量個(gè)人數(shù)據(jù)的處理,涉及隱私保護(hù)問題。目前,70多個(gè)國家和地區(qū)已經(jīng)針對個(gè)人數(shù)據(jù)的跨境流動進(jìn)行了立法保護(hù),以我國8個(gè)主要發(fā)包國(地區(qū))的相關(guān)法律規(guī)定為例可以看出,接包國是否具有隱私保護(hù)立法和是否加入具有法律約束力的隱私規(guī)則體系成為發(fā)包國(地區(qū))的重要考慮因素。為了保證數(shù)據(jù)外包業(yè)務(wù)的健康發(fā)展,我國應(yīng)盡早頒布全國性的個(gè)人數(shù)據(jù)保護(hù)法律或加入?yún)^(qū)域跨境隱私規(guī)則體系。
[Abstract]:Data outsourcing is an important part of international service outsourcing in China. It is an opportunity to improve the level and competition level of outsourcing in China. Data outsourcing business includes a large number of personal data processing, involving privacy protection issues. At present, more than 70 countries and regions have carried out legislative protection against the cross-border movement of personal data. Take the relevant laws and regulations of the eight major contracting countries (regions) in China as an example, we can see that Whether the contracting country has privacy protection legislation or not and whether to join the legally binding privacy rules system are important considerations for the contracting country (region). In order to ensure the healthy development of data outsourcing business, our country should enact national personal data protection laws as soon as possible or join the system of regional cross-border privacy rules.
