【摘要】：《鹿特丹規(guī)則》采用了完全過錯(cuò)責(zé)任的責(zé)任基礎(chǔ),責(zé)任期間擴(kuò)展到“門至門”,廢除了承運(yùn)人的航海過失免責(zé),提高了承運(yùn)人的責(zé)任限額,加重了承運(yùn)人的責(zé)任,開創(chuàng)了將海事公約的規(guī)定有條件地適用于陸上區(qū)段運(yùn)輸?shù)南群?促進(jìn)了國(guó)際多式聯(lián)運(yùn)法律的統(tǒng)一,成為一個(gè)調(diào)整全部運(yùn)輸方式的統(tǒng)一的國(guó)際貨物運(yùn)輸規(guī)則。這為國(guó)際貿(mào)易業(yè)和國(guó)際航運(yùn)業(yè)長(zhǎng)期未能解決的國(guó)際多式聯(lián)運(yùn)的法律規(guī)范統(tǒng)一問題提供了解決的渠道。本文試圖從《鹿特丹規(guī)則》中關(guān)于“履約方”的概念出發(fā),將國(guó)際多式聯(lián)運(yùn)經(jīng)營(yíng)人與區(qū)段承運(yùn)人之間的關(guān)系加以厘清,并探討在國(guó)際多式聯(lián)運(yùn)的過程中產(chǎn)生的貨物滅失和損壞而產(chǎn)生的賠償責(zé)任的歸屬問題。 本文除引言及結(jié)語(yǔ)外,由四部分組成,第一部分緒論部分介紹了本文的研究背景和有關(guān)國(guó)際多式聯(lián)運(yùn)法律規(guī)則的發(fā)展現(xiàn)狀。第二部分論述了多式聯(lián)運(yùn)經(jīng)營(yíng)人在《鹿特丹規(guī)則》中的法律地位。第三部分分析了《鹿特丹規(guī)則》下國(guó)際多式聯(lián)運(yùn)經(jīng)營(yíng)人的責(zé)任。第四部分討論了《鹿特丹規(guī)則》中多式聯(lián)運(yùn)經(jīng)營(yíng)人責(zé)任的規(guī)定對(duì)我國(guó)國(guó)內(nèi)立法的影響。 本文認(rèn)為在《鹿特丹規(guī)則》項(xiàng)下,國(guó)際多式聯(lián)運(yùn)經(jīng)營(yíng)人享有承運(yùn)人的權(quán)利,承擔(dān)承運(yùn)人的義務(wù)；區(qū)段承運(yùn)人的權(quán)利義務(wù)被包含在“履約方”概念的權(quán)利義務(wù)之下。并據(jù)此展開討論,在《鹿特丹規(guī)則》項(xiàng)下,國(guó)際多式聯(lián)運(yùn)經(jīng)營(yíng)人的過錯(cuò)責(zé)任基礎(chǔ)、“門到門”的責(zé)任期間和責(zé)任限制,最后討論了我國(guó)有關(guān)多式聯(lián)運(yùn)責(zé)任立法的不足與完善。
[Abstract]:The Rotterdam rules adopt the liability basis of total fault liability, and the period of liability extends to "door to door", which abolishes the carrier's exemption from maritime negligence, raises the carrier's liability limit and increases the carrier's liability. The maritime convention is the first to apply the maritime convention to the onshore section transport, which promotes the unification of the international multimodal transport law and becomes a uniform international freight transport regulation to adjust all modes of transport. This provides a channel for the international trade and international shipping industry to solve the problem of the unification of international multimodal transport laws and regulations that have not been solved for a long time. This paper attempts to clarify the relationship between international multimodal transport operators and section carriers from the concept of "performing party" in the Rotterdam rules. The attribution of liability arising from the loss and damage of goods in the process of international multimodal transport is also discussed. In addition to the introduction and conclusion, this paper consists of four parts. The first part introduces the background of the research and the development of international multimodal transport legal rules. The second part discusses the legal status of multimodal transport operator in Rotterdam rules. The third part analyzes the responsibility of international multimodal transport operators under the Rotterdam rules. The fourth part discusses the influence of the regulation of the liability of multimodal transport operator in the Rotterdam rules on the domestic legislation of our country. Under the Rotterdam rules, the international multimodal transport operator is entitled to the carrier's rights and obligations, and the section carrier's rights and obligations are included under the concept of "performing party". Under the item of Rotterdam rules, the fault liability foundation of international multimodal transport operators, the liability period and limitation of door-to-door liability are discussed. Finally, the deficiency and perfection of our country's legislation on multimodal transport liability are discussed.
