【摘要】:《鹿特丹規(guī)則》采用了完全過錯責(zé)任的責(zé)任基礎(chǔ),責(zé)任期間擴展到“門至門”,廢除了承運人的航海過失免責(zé),提高了承運人的責(zé)任限額,加重了承運人的責(zé)任,開創(chuàng)了將海事公約的規(guī)定有條件地適用于陸上區(qū)段運輸?shù)南群?促進了國際多式聯(lián)運法律的統(tǒng)一,成為一個調(diào)整全部運輸方式的統(tǒng)一的國際貨物運輸規(guī)則。這為國際貿(mào)易業(yè)和國際航運業(yè)長期未能解決的國際多式聯(lián)運的法律規(guī)范統(tǒng)一問題提供了解決的渠道。本文試圖從《鹿特丹規(guī)則》中關(guān)于“履約方”的概念出發(fā),將國際多式聯(lián)運經(jīng)營人與區(qū)段承運人之間的關(guān)系加以厘清,并探討在國際多式聯(lián)運的過程中產(chǎn)生的貨物滅失和損壞而產(chǎn)生的賠償責(zé)任的歸屬問題。 本文除引言及結(jié)語外,由四部分組成,第一部分緒論部分介紹了本文的研究背景和有關(guān)國際多式聯(lián)運法律規(guī)則的發(fā)展現(xiàn)狀。第二部分論述了多式聯(lián)運經(jīng)營人在《鹿特丹規(guī)則》中的法律地位。第三部分分析了《鹿特丹規(guī)則》下國際多式聯(lián)運經(jīng)營人的責(zé)任。第四部分討論了《鹿特丹規(guī)則》中多式聯(lián)運經(jīng)營人責(zé)任的規(guī)定對我國國內(nèi)立法的影響。 本文認為在《鹿特丹規(guī)則》項下,國際多式聯(lián)運經(jīng)營人享有承運人的權(quán)利,承擔承運人的義務(wù);區(qū)段承運人的權(quán)利義務(wù)被包含在“履約方”概念的權(quán)利義務(wù)之下。并據(jù)此展開討論,在《鹿特丹規(guī)則》項下,國際多式聯(lián)運經(jīng)營人的過錯責(zé)任基礎(chǔ)、“門到門”的責(zé)任期間和責(zé)任限制,最后討論了我國有關(guān)多式聯(lián)運責(zé)任立法的不足與完善。
[Abstract]:The Rotterdam rules adopt the liability basis of total fault liability, and the period of liability extends to "door to door", which abolishes the carrier's exemption from maritime negligence, raises the carrier's liability limit and increases the carrier's liability. The maritime convention is the first to apply the maritime convention to the onshore section transport, which promotes the unification of the international multimodal transport law and becomes a uniform international freight transport regulation to adjust all modes of transport. This provides a channel for the international trade and international shipping industry to solve the problem of the unification of international multimodal transport laws and regulations that have not been solved for a long time. This paper attempts to clarify the relationship between international multimodal transport operators and section carriers from the concept of "performing party" in the Rotterdam rules. The attribution of liability arising from the loss and damage of goods in the process of international multimodal transport is also discussed. In addition to the introduction and conclusion, this paper consists of four parts. The first part introduces the background of the research and the development of international multimodal transport legal rules. The second part discusses the legal status of multimodal transport operator in Rotterdam rules. The third part analyzes the responsibility of international multimodal transport operators under the Rotterdam rules. The fourth part discusses the influence of the regulation of the liability of multimodal transport operator in the Rotterdam rules on the domestic legislation of our country. Under the Rotterdam rules, the international multimodal transport operator is entitled to the carrier's rights and obligations, and the section carrier's rights and obligations are included under the concept of "performing party". Under the item of Rotterdam rules, the fault liability foundation of international multimodal transport operators, the liability period and limitation of door-to-door liability are discussed. Finally, the deficiency and perfection of our country's legislation on multimodal transport liability are discussed.
