氣候變化背景下的知識(shí)產(chǎn)權(quán)國際保護(hù)之爭

【摘要】:在氣候變化與知識(shí)產(chǎn)權(quán)的問題上,厄瓜多爾等發(fā)展中國家在2013年6月至2014年10月的TRIPS理事會(huì)議中闡述了修訂TRIPS協(xié)議的意見以求能夠最大限度地獲取無害環(huán)境技術(shù)及其產(chǎn)品,但美國等發(fā)達(dá)國家堅(jiān)決拒絕修正TRIPS協(xié)議,認(rèn)為非知識(shí)產(chǎn)權(quán)因素是妨礙發(fā)展中國家應(yīng)對氣候變化的主要原因。雙方產(chǎn)生分歧的原因不僅在于對各自國家利益的訴求,也在于TRIPS協(xié)議和無害環(huán)境技術(shù)自身因素?紤]到人權(quán)保護(hù)的需要和當(dāng)前處于知識(shí)積累階段的現(xiàn)狀,應(yīng)當(dāng)以技術(shù)轉(zhuǎn)讓重于技術(shù)創(chuàng)新的方式適應(yīng)和減緩氣候變化,修訂TRIPS協(xié)議以幫助發(fā)展中國家獲取無害環(huán)境技術(shù)及其產(chǎn)品。
[Abstract]:On the issue of climate change and intellectual property rights, developing countries such as Ecuador, at the TRIPS governing Council meeting from June 2013 to October 2014, expressed their views on the revision of the TRIPS Agreement with a view to maximizing access to environmentally sound technologies and their products, But developed countries such as the United States have steadfastly refused to amend the TRIPS, arguing that non-intellectual property factors are a major impediment to developing countries' response to climate change. The differences lie not only in their national interests, but also in the TRIPS and environmentally sound technologies themselves. Taking into account the need for human rights protection and the current state of knowledge accumulation, climate change adaptation and mitigation should be carried out in a manner where technology transfer is more important than technological innovation, and the TRIPS protocol should be revised to help developing countries gain access to environmentally sound technologies and their products.
