【摘要】：中國基于重大歷史利益對南海U形線內(nèi)"附近海域"和"相關(guān)海域"外"其他海域"主張歷史性權(quán)利十分必要。重大歷史利益帶來的比較優(yōu)勢及其合法性、歷史性權(quán)利模糊性帶來的彈性空間和南海其它周邊國家權(quán)利主張欠合理性帶給中國的優(yōu)勢都讓此主張較可行。中國在該海域可考慮:在"擱置爭議,共同開發(fā)"前提下,提煉其享有的重大歷史利益并整理相關(guān)證據(jù);闡明所主張的歷史性權(quán)利的內(nèi)涵;適時正式提出歷史性權(quán)利主張;統(tǒng)一各種維權(quán)執(zhí)法行動。
[Abstract]:On the basis of important historical interests, it is necessary for China to claim historical rights in the "adjacent waters" and "other sea areas" outside the U-shaped line of the South China Sea. The comparative advantage and its legitimacy brought by major historical interests, the flexible space brought by the ambiguity of historical rights and the superiority brought to China by other neighboring countries in the South China Sea make this claim more feasible. China may consider: on the premise of "shelving disputes and jointly developing", refining its major historical interests and sorting out relevant evidence; clarifying the connotation of historical rights claimed; formally putting forward historical claims in due course; Unify all kinds of rights enforcement actions.
