【摘要】：本文主要討論了服務(wù)貿(mào)易補(bǔ)貼在《服務(wù)貿(mào)易總協(xié)定》（GATS）談判的進(jìn)程中如何進(jìn)一步完善的問題。首先文章對GATS現(xiàn)存的補(bǔ)貼機(jī)制進(jìn)行簡要的評述，談?wù)摿税▏H服務(wù)貿(mào)易與多邊貿(mào)易體系之間的關(guān)系，，GATS第15條服務(wù)補(bǔ)貼規(guī)則與貿(mào)易扭曲、與公共政策目標(biāo)，以及現(xiàn)有關(guān)于服務(wù)補(bǔ)貼領(lǐng)域的數(shù)據(jù)信息的掌握情況。另外，論文還重點(diǎn)分析了具有貿(mào)易扭曲作用的服務(wù)補(bǔ)貼的分類、定義、現(xiàn)有GATS的補(bǔ)貼規(guī)則與救濟(jì)方式、服務(wù)補(bǔ)貼與反補(bǔ)貼措施的適用性問題，其中主要采用《補(bǔ)貼與反補(bǔ)貼措施協(xié)定》（ASCM）、GATS以及歐盟國家援助法律規(guī)則若干條文釋義的比對分析策略，并綜合了WTO爭端解決機(jī)制和歐盟層面案例的實(shí)證分析方法，對未來的服務(wù)貿(mào)易補(bǔ)貼規(guī)則的建立及完善提出了較為積極的建議。 筆者認(rèn)為，未來的服務(wù)補(bǔ)貼規(guī)則應(yīng)當(dāng)僅規(guī)范具有貿(mào)易扭曲效果的補(bǔ)貼，并將服務(wù)補(bǔ)貼劃分為出口導(dǎo)向型補(bǔ)貼和進(jìn)口替代型補(bǔ)貼，同時(shí)結(jié)合WTO和歐盟層面立法和實(shí)踐的經(jīng)驗(yàn)對服務(wù)貿(mào)易補(bǔ)貼的定義做出了合理的建議。文章全面系統(tǒng)地剖析了現(xiàn)有GATS的補(bǔ)貼規(guī)則與救濟(jì)方式，最后討論了反補(bǔ)貼措施這種單邊貿(mào)易救濟(jì)機(jī)制引入服務(wù)補(bǔ)貼領(lǐng)域的合理性及可行性的問題。
[Abstract]:This paper mainly discusses how to improve the service trade subsidies in the negotiation process of GATS (General Agreement on Trade in Services). First of all, this paper briefly reviews the existing subsidy mechanism of GATS, and discusses the relationship between international trade in services and multilateral trading system Article 15, the rules of service subsidies and trade distortions, and the objectives of public policy. And the availability of data and information in the area of service subsidies. In addition, the thesis also focuses on the classification and definition of trade-distorting service subsidies, the existing GATS subsidy rules and relief methods, the applicability of service subsidies and countervailing measures. This paper mainly adopts the comparative analysis strategy of "Agreement on subsidies and countervailing measures" and the interpretation of several articles of the EU National Assistance Law, and synthesizes the WTO dispute settlement mechanism and the empirical analysis methods of EU cases. Some positive suggestions are put forward for the establishment and perfection of the subsidy rules of service trade in the future. The author thinks that the future service subsidy rules should only regulate the trade-distorting subsidies and divide the service subsidies into export-oriented subsidies and import-substitution subsidies. At the same time, combining the experience of legislation and practice at the level of WTO and EU, this paper makes some reasonable suggestions on the definition of service trade subsidy. This paper comprehensively and systematically analyzes the existing GATS subsidy rules and remedies, and finally discusses the rationality and feasibility of the unilateral trade relief mechanism of countervailing measures in the field of service subsidies.
