【摘要】：伴隨經(jīng)濟(jì)全球化的進(jìn)一步發(fā)展,國際貿(mào)易的不斷推進(jìn),各國之間的經(jīng)濟(jì)貿(mào)易往來逐漸增多,由此引發(fā)的國際間的商事糾紛也越來越多。由于自身便捷、中立、靈活、自治等特點(diǎn),國際商事仲裁日益受到青睞。臨時(shí)措施在仲裁中有著舉足輕重的地位,它一定程度上有效的避免了爭議標(biāo)的的損壞與滅失,保障了仲裁程序的順利進(jìn)行,保障了當(dāng)事人的權(quán)利以及仲裁裁決的公平性。但是,即便如此,在實(shí)踐當(dāng)中臨時(shí)措施還是存在著不少的難點(diǎn)與問題,比如臨時(shí)措施申請(qǐng)的提出時(shí)間與處理主體,以及臨時(shí)措施的域外執(zhí)行都面臨不少障礙�；诖�,各國已經(jīng)開始逐步完善有關(guān)臨時(shí)措施的立法規(guī)定,聯(lián)合國國際貿(mào)易法委員會(huì)也與2006年對(duì)《聯(lián)合國國際商事仲裁示范法》中臨時(shí)措施的相關(guān)條文進(jìn)行了修訂。而在我國,由于法律條文的不盡完善,實(shí)踐操作性的缺少,導(dǎo)致我國的國際商事仲裁法律制度脫離了國際上的普遍做法與發(fā)展趨勢(shì),毫無疑問這會(huì)阻礙我國國際商事仲裁今后的發(fā)展。因此我國對(duì)臨時(shí)措施的立法完善是必須也是必要的。 本文主要對(duì)國際商事仲裁臨時(shí)保全措施的若干問題及其在中國的現(xiàn)狀與完善問題進(jìn)行了論述。全文共分四章,內(nèi)容上涉及了國際商事仲裁臨時(shí)保全措施的特征、形式等基本問題,主要論述了國際商事仲裁臨時(shí)保全措施的發(fā)布和執(zhí)行問題,并針對(duì)我國相關(guān)法律規(guī)定提出了自己的完善建議。 第一章是對(duì)臨時(shí)措施的概述部分,主要介紹了臨時(shí)措施的概念、分類,包括學(xué)理分類和《示范法》的規(guī)定。 第二章是臨時(shí)措施的發(fā)布問題,主要為兩方面問題,包括臨時(shí)措施發(fā)布權(quán)模式和臨時(shí)措施發(fā)布時(shí)間,根據(jù)國際上各國的立法實(shí)踐,重點(diǎn)闡述了發(fā)布權(quán)的幾種模式。除此之外還包括臨時(shí)措施的發(fā)布條件。 第三章是臨時(shí)措施的執(zhí)行問題,此部分除了介紹部分國家臨時(shí)措施域外執(zhí)行的實(shí)踐外,主要圍繞臨時(shí)措施的域外執(zhí)行涉及的兩個(gè)問題展開論述。 第四章是中國臨時(shí)保全措施的現(xiàn)狀和完善建議,本文在此部分主要分析了中國立法和司法方面的不足,進(jìn)而就如何完善我國仲裁臨時(shí)保全措施提出相關(guān)建議。
[Abstract]:With the further development of economic globalization and the continuous promotion of international trade, the economic and trade exchanges between countries are gradually increasing, which leads to more and more international commercial disputes. Due to its convenience, neutrality, flexibility, autonomy and other characteristics, international commercial arbitration is increasingly favored. Interim measures play an important role in arbitration. To a certain extent, they effectively avoid the damage and loss of the object of dispute, ensure the smooth progress of the arbitration procedure, protect the rights of the parties and the fairness of the arbitration award. However, even in practice, there are still many difficulties and problems in the practice of interim measures, such as the time of application for interim measures and the subject of processing, as well as the extraterritorial implementation of interim measures are facing a lot of obstacles. Based on this, countries have begun to improve the relevant legislative provisions on interim measures, and the United Nations Commission on International Trade Law revised the relevant provisions of interim measures in the United Nations Model Law on International Commercial Arbitration in 2006. In our country, due to the imperfect legal provisions and the lack of practical operation, the legal system of international commercial arbitration in our country deviates from the general practice and development trend in the world. There is no doubt that this will hinder the future development of international commercial arbitration in China. Therefore, it is necessary and necessary for our country to perfect the legislation of interim measures. This paper mainly discusses some problems of interim measures of protection in international commercial arbitration and its present situation and perfection in China. The full text is divided into four chapters, which involve the characteristics and forms of interim measures of protection in international commercial arbitration, and mainly discuss the issue and implementation of interim measures of protection in international commercial arbitration. And in view of the relevant laws and regulations of our country put forward their own perfect suggestions. The first chapter is an overview of interim measures, mainly introduces the concept of interim measures, classification, including the academic classification and the provisions of the Model Law. The second chapter is about the issue of interim measures, mainly in two aspects, including the mode and time of issuing interim measures. According to the legislative practice of various countries in the world, this paper focuses on several modes of the right to issue. It also includes conditions for the release of interim measures. The third chapter is about the implementation of interim measures. In addition to introducing the practice of the extraterritorial implementation of interim measures in some countries, this part mainly discusses the two issues involved in the extraterritorial implementation of interim measures. The fourth chapter is the status quo of interim measures of protection in China and suggestions for improvement. In this part, the author mainly analyzes the shortcomings of China's legislation and judicature, and then puts forward some relevant suggestions on how to perfect the interim measures of protection in arbitration in China.
