【摘要】：涉港民事案件地域管轄權(quán)沖突源于管轄根據(jù)的差異,特別管轄權(quán)和裁量管轄權(quán)沖突源于過度管轄;專屬管轄權(quán)沖突體現(xiàn)為內(nèi)地專屬管轄權(quán)與香港其他管轄權(quán)沖突,協(xié)議管轄權(quán)沖突主要是因?yàn)檫m用條件和效力認(rèn)定不同引起。兩地立法對(duì)管轄權(quán)沖突持寬松態(tài)度,司法實(shí)踐中除都采用不方便法院原則外,還各自運(yùn)用先受理法院和禁訴令。涉港民事管轄權(quán)沖突的解決應(yīng)該針對(duì)不同類型的管轄權(quán)沖突形態(tài)靈活采取多種解決機(jī)制,可構(gòu)建為專屬管轄權(quán)和協(xié)議管轄權(quán)優(yōu)先,以先受理法院為主,不方便法院為例外的多層次機(jī)制。
[Abstract]:The conflict of territorial jurisdiction in civil cases involving Hong Kong originates from the differences in the basis of jurisdiction, and the conflict of special and discretionary jurisdiction stems from overjurisdiction; the conflict of exclusive jurisdiction is embodied in the conflict between the exclusive jurisdiction of the mainland and other jurisdictions of Hong Kong. The conflict of jurisdiction is mainly caused by the difference of applicable conditions and validity. The legislation of both places is lenient to the conflict of jurisdiction. In judicial practice, in addition to the inconvenient court principle, they also use the court first and the injunction proscribed. The settlement of civil jurisdiction conflicts involving Hong Kong should adopt a variety of settlement mechanisms flexibly according to different types of jurisdiction conflicts, which can be constructed as exclusive jurisdiction and agreement jurisdiction, with the priority of accepting the court first. Inconvenient courts as exceptions to the multi-level mechanism.
