【摘要】：國際組織豁免經(jīng)歷了從外交豁免到職能豁免的演變,直到聯(lián)合國建立才真正確立了國際組織豁免的職能必要性理論。對于國際組織高級職員而言,豁免是指其不受一國國內(nèi)法院的管轄。國際組織高級職員享有職能性豁免,為了履行組織職務(wù)、達(dá)成組織目標(biāo),其公務(wù)行為受到豁免的保護(hù)。在很多情況下,出于履行職能的需要,也會授予部分國際組織高級職員外交豁免,但即使是那些在享有職能性豁免的同時還享有外交豁免的國際組織高級職員,也只就其公務(wù)行為享有豁免,非公務(wù)性行為依然不受豁免的保護(hù)。國際貨幣基金組織及其職員只享有職能豁免,不享有外交豁免,其私人行為不能豁免于國內(nèi)法院的管轄。
[Abstract]:The immunity of international organizations has evolved from diplomatic immunity to functional immunity, and the theory of functional necessity of immunity of international organizations was not established until the establishment of the United Nations. In the case of officers of an international organization, immunity means that it is not subject to the jurisdiction of the domestic courts of a State. Officers of international organizations enjoy functional immunity, and their official acts are protected in order to carry out organizational functions and achieve organizational objectives. In many cases, diplomatic immunity would also be granted to senior officials of international organizations for the purpose of performing their functions, but even those officers of international organizations who enjoyed diplomatic immunity while enjoying functional immunity, They enjoy immunity only in respect of their official acts, while non-official acts remain unprotected. The IMF and its staff enjoy only functional immunity, not diplomatic immunity, and their private acts cannot be exempted from the jurisdiction of domestic courts.
