【摘要】：航空運輸是為世界上許多國家所廣泛使用的交通運輸方式之一,航空客運承運人為旅客提供了安全、高效、便捷的運輸服務,但是隨著航空業(yè)的發(fā)展,航空事故日益增多,引發(fā)了承運人與旅客之間越來越多的糾紛。在國際航空事故導致的損害賠償訴訟中,對于旅客身體傷害予以賠償沒有爭議,但對于事故所導致的旅客精神損害是否予以賠償,一直存有爭議。本文從對國際航空公約相關(guān)條款解讀入手,分析國際和國內(nèi)案例,論證對民航運輸事故導致的精神損害給予賠償?shù)暮侠硇院涂尚行?并對我國《民用航空法》的相關(guān)修改提出建議。 導論介紹了本文的選題背景和選題意義。 第一章是精神損害賠償概述,第一節(jié)分別介紹了精神損害概念及精神損害賠償?shù)母拍?第二節(jié)介紹了民航客運精神損害賠償?shù)奶攸c。 第二章是國際公約關(guān)于航空旅客精神損害賠償?shù)囊?guī)定。首先介紹了華沙體系各個公約關(guān)于民航運輸中旅客精神損害賠償?shù)牧⒎ǜ艣r。其次介紹了《蒙特利爾公約》關(guān)于旅客精神損害賠償?shù)囊?guī)定。 第三章介紹了各國關(guān)于航空旅客精神損害賠償?shù)乃痉▽嵺`。包括有代表性的國際航空大國美國和英國關(guān)于航空旅客精神損害的三種情形分別是否給予賠償?shù)乃痉▽嵺`。 第四章是我國司法實踐及完善我國民航客運精神損害賠償?shù)牧⒎ńㄗh。首先介紹了我國國內(nèi)相關(guān)司法實踐。接著論證了民航旅客精神損害賠償立法的可行性。最后是立法建議包括制定專門的沖突規(guī)范,以及設(shè)立專門的航空客運精神損害賠償制度。
[Abstract]:Air transportation is one of the widely used modes of transportation in many countries in the world. Air passenger carriers provide safe, efficient and convenient transportation services for passengers. However, with the development of aviation industry, the number of aviation accidents is increasing day by day. This has led to more and more disputes between carriers and passengers. In the litigation of compensation for damages caused by international aviation accidents, there is no dispute about compensation for passengers' bodily injury, but whether to compensate for the mental damage caused by the accidents has always been controversial. This paper begins with the interpretation of relevant articles of international aviation conventions, analyzes international and domestic cases, and proves the reasonableness and feasibility of compensation for mental damage caused by civil aviation transportation accidents. And put forward the suggestion to the civil aviation law of our country. The introduction introduces the background and significance of this paper. The first chapter is an overview of the compensation for mental damage. The first section introduces the concept of mental damage and the concept of compensation for spiritual damage. The second section introduces the characteristics of the compensation for spiritual damage in civil aviation passenger transportation. The second chapter is the international convention about the air passenger spirit damage compensation stipulation. First of all, it introduces the general situation of the legislation about the compensation of passengers' moral damage in civil aviation transportation under various conventions of Warsaw system. Secondly, it introduces the provisions of the Montreal Convention on compensation for moral damage to travellers. The third chapter introduces the judicial practice of compensation for spiritual damage of air passengers. It includes the judicial practice of whether the United States and the United Kingdom, the representative international aviation powers, give compensation for moral damage to air passengers. The fourth chapter is our country judicial practice and consummates our country civil aviation passenger transport spirit damage compensation legislation suggestion. First of all, it introduces the relevant judicial practice in our country. Then it demonstrates the feasibility of civil aviation passenger mental damage compensation legislation. Finally, the legislative proposals include the establishment of special conflict norms and the establishment of a special air passenger transport compensation system for moral damage.
