【摘要】：2010年中國(guó)對(duì)稀土元素產(chǎn)品的出口限制引起世界的關(guān)注,其與2009年中國(guó)原材料出口限制措施案有類似之處,均反映了中國(guó)與其他WTO成員方之間的資源"攻守"博弈,但其具體形式又有新發(fā)展。本文將結(jié)合WTO規(guī)則及以往爭(zhēng)端解決實(shí)踐,深入探究其實(shí)質(zhì)與發(fā)展,試圖提出應(yīng)對(duì)措施,以期能更好地對(duì)這一潛在爭(zhēng)端做好充分準(zhǔn)備,維護(hù)中國(guó)的正當(dāng)利益。
[Abstract]:China's export restrictions on rare earth elements products in 2010 have attracted worldwide attention, which is similar to the 2009 case of China's export restrictions on raw materials, reflecting the "offensive and defensive" game of resources between China and other WTO members. But its concrete form also has the new development. Based on the WTO rules and previous dispute settlement practice, this paper will explore its essence and development, and try to put forward some countermeasures in order to better prepare for this potential dispute and safeguard China's legitimate interests.
