【摘要】：2010年中國對稀土元素產(chǎn)品的出口限制引起世界的關注,其與2009年中國原材料出口限制措施案有類似之處,均反映了中國與其他WTO成員方之間的資源"攻守"博弈,但其具體形式又有新發(fā)展。本文將結合WTO規(guī)則及以往爭端解決實踐,深入探究其實質(zhì)與發(fā)展,試圖提出應對措施,以期能更好地對這一潛在爭端做好充分準備,維護中國的正當利益。
[Abstract]:China's export restrictions on rare earth elements products in 2010 have attracted worldwide attention, which is similar to the 2009 case of China's export restrictions on raw materials, reflecting the "offensive and defensive" game of resources between China and other WTO members. But its concrete form also has the new development. Based on the WTO rules and previous dispute settlement practice, this paper will explore its essence and development, and try to put forward some countermeasures in order to better prepare for this potential dispute and safeguard China's legitimate interests.
