【摘要】：隨著海峽兩岸政策開放,民眾之間互通日益頻繁,臺(tái)胞與大陸民眾之間逐漸形成了各種法律關(guān)系,其中,由于婚姻家庭所產(chǎn)生的財(cái)產(chǎn)繼承糾紛,以及因此而引發(fā)涉臺(tái)婚姻繼承法律問(wèn)題的不容忽視。對(duì)臺(tái)遺產(chǎn)繼承案例中,較為敏感且社會(huì)各界談?wù)撦^多的就是關(guān)于身份暨待認(rèn)定的臺(tái)胞在大陸的非婚生子女(私生子、女)繼承問(wèn)題。 在以非婚生子女最大利益為目的,保障非婚生子女基本權(quán)益的基礎(chǔ)上,本文討論了“涉臺(tái)非婚生子女”主體構(gòu)成及身份認(rèn)定,“涉臺(tái)非婚生子女”行使繼承權(quán)之阻礙,保護(hù)兩岸“涉臺(tái)非婚生子女”合法權(quán)益,海峽兩岸法律沖突及解決模式等等內(nèi)容,旨在通過(guò)逐步剖析這些法律問(wèn)題,以此探討兩岸相關(guān)法律合理統(tǒng)一,力求解決涉臺(tái)大陸非婚生子女對(duì)臺(tái)方在臺(tái)遺產(chǎn)的繼承問(wèn)題,并提出相關(guān)建議。
[Abstract]:With the opening up of cross-strait policies and the increasingly frequent exchange of people between the people, various legal relations have gradually formed between Taiwan compatriots and the people of the mainland. Among them, due to disputes over property inheritance arising from marriage and family, And the legal issues of marriage succession related to Taiwan should not be ignored. In the case of inheritance to Taiwan, what is more sensitive and much discussed in the society is the inheritance of illegitimate children (illegitimate, female) born out of wedlock of Taiwan compatriots in mainland China. On the basis of protecting the basic rights and interests of children born out of wedlock for the purpose of the best interests of children born out of wedlock, this paper discusses the main body composition and identity determination of children born out of wedlock in Taiwan, and the obstacles to the exercise of inheritance rights of children born out of wedlock in Taiwan. The purpose of protecting the legitimate rights and interests of children born out of wedlock to Taiwan, the conflict of laws across the Taiwan Strait and the solution model is to explore the reasonable unification of relevant laws across the Taiwan Strait by analyzing these legal issues step by step. To solve the problem of inheritance of illegitimate children in Taiwan, and put forward some suggestions.
