【摘要】：可再生能源對于保障能源安全、應對氣候變化、推動經(jīng)濟發(fā)展有著十分重要的戰(zhàn)略意義。能否在可再生能源及其相關產(chǎn)業(yè)的國際競爭中占據(jù)先機已成為各國關注的焦點,為此各國制訂了大量的包括補貼措施在內(nèi)的可再生能源扶持措施以推動本國可再生能源的發(fā)展。然而,世界貿(mào)易組織的補貼與反補貼規(guī)則并未對包括可再生能源補貼在內(nèi)的綠色補貼與一般補貼加以任何區(qū)分。這不僅產(chǎn)生了貿(mào)易與環(huán)境的脫節(jié),也使得成員國的可再生能源補貼措施的合法性受到質(zhì)疑;這既不利于各國采取多邊和國內(nèi)措施應對氣候變化和能源危機,也不利于國際貿(mào)易關系的穩(wěn)定發(fā)展。世界貿(mào)易組織應以可再生能源補貼問題為契機,適時對其綠色補貼規(guī)則加以完善,對有關可再生能源的禁止性補貼、可訴性補貼和不可訴性補貼進行明確規(guī)定。
[Abstract]:Renewable energy plays an important strategic role in ensuring energy security, coping with climate change and promoting economic development. Whether to occupy the first opportunity in the international competition of renewable energy and its related industries has become the focus of attention of all countries. For this reason, countries have formulated a large number of renewable energy support measures, including subsidies, to promote the development of renewable energy in their own countries. However, the WTO rules on subsidies and countervailing do not distinguish between green subsidies, including renewable energy subsidies, and general subsidies. This not only creates a disconnect between trade and the environment, but also calls into question the legitimacy of renewable energy subsidies by member States; it is not conducive to multilateral and domestic measures to address climate change and the energy crisis, Nor is it conducive to the stable development of international trade relations. The World Trade Organization should take the issue of renewable energy subsidies as an opportunity to improve its green subsidy rules at the right time and make clear provisions on prohibited subsidies, actionable subsidies and non-actionable subsidies related to renewable energy.
