海上安全風險管控的區(qū)域性安排與制度構建

【摘要】:海上安全風險國際管控呈公約規(guī)制和區(qū)域性安排并存的二元模式。區(qū)域性安排的理念、自身優(yōu)勢和實踐效果,使區(qū)域性安排成為海上安全風險國際管控的一種較優(yōu)選擇。針對區(qū)域性安排存在的"弱強制性"、"劃海而治"與"規(guī)則沖突"等不足,需要從硬法和軟法兩個維度予以完善。硬法維度即實現(xiàn)區(qū)域性安排的法律化,包括借鑒補強機制等外部措施實現(xiàn)區(qū)域性安排的強制約束力,推動區(qū)域性安排轉化為一種區(qū)域習慣(法)規(guī)則;軟法維度即協(xié)調(diào)單邊和各區(qū)域性安排的風險管控措施,并借助海事安全條約強制履約審核實現(xiàn)"再協(xié)調(diào)"。
[Abstract]:The international control of maritime safety risk is a dual model of convention regulation and regional arrangement. The idea of regional arrangement, its own advantage and practical effect make regional arrangement a better choice for international control of maritime safety risk. In view of the shortcomings of "weak compulsion", "rule over the sea" and "conflict of rules" existing in regional arrangements, it is necessary to perfect the two dimensions of hard law and soft law. The dimension of hard law is to realize the legalization of regional arrangements, including using external measures such as reinforcement mechanism to realize the binding force of regional arrangements, and to promote the conversion of regional arrangements into a kind of regional customary (legal) rules; The dimension of soft law is to coordinate the risk control measures of unilateral and regional arrangements, and to realize "recoordination" with the help of mandatory compliance audit of maritime safety treaties.
