【摘要】：信用證被譽(yù)為維持國際貿(mào)易生命的“血液”，，隨著各國交易的日益頻繁以及科學(xué)技術(shù)的迅速發(fā)展，信用證電子化的趨勢越加明顯。電子信用證作為一種新興的支付方式在國際貿(mào)易中的地位越來越重要，人們希望交易效率提高的同時支付安全也有相應(yīng)的保證。本文通過對電子信用證安全性法律問題的研究，對我們?nèi)娴卣J(rèn)識和了解電子信用證、確保電子支付安全，以及我國相關(guān)立法的完善都有著重要意義。 信用證電子化后主要面臨以下幾個安全隱患：支付系統(tǒng)的安全性問題、信息的保密性與完整性、當(dāng)事人身份的真實(shí)性、主體多元化導(dǎo)致的安全問題、電子信用證欺詐以及電子證據(jù)的收集與效力問題。這些安全隱患的防范不能僅僅依靠法律手段，而應(yīng)當(dāng)將其置于電子商務(wù)這個大環(huán)境中結(jié)合技術(shù)手段加以解決。我國在這一領(lǐng)域的發(fā)展還很不成熟，需要借鑒國際上成功的立法模式及先進(jìn)的科學(xué)技術(shù)加以改進(jìn)和完善，以推動我國國際貿(mào)易的快速健康地發(fā)展。
[Abstract]:Letters of credit are regarded as the "blood" to maintain the life of international trade. With the increasingly frequent transactions in various countries and the rapid development of science and technology, the trend of electronic letters of credit becomes more and more obvious. Electronic letter of credit (E-L / C) is becoming more and more important in international trade as a new payment method. It is hoped that the transaction efficiency will be improved and the payment security will be guaranteed accordingly. Through the research on the legal problems of the security of electronic letters of credit, it is of great significance for us to fully understand and understand electronic letters of credit, to ensure the security of electronic payment, and to improve the relevant legislation of our country. The letter of credit is faced with the following security problems: the security of payment system, the confidentiality and integrity of information, the authenticity of the identity of the parties, and the security problems caused by the diversification of the subject. E-L / C fraud and the collection and validity of electronic evidence. The prevention of these security risks can not only rely on legal means, but should be placed in the general environment of electronic commerce combined with technical means to solve. The development of our country in this field is still very immature, we need to learn from the international successful legislative model and advanced science and technology to improve and perfect, in order to promote the rapid and healthy development of China's international trade.
