【摘要】：從目前跨國破產(chǎn)法立法與司法實踐發(fā)展來看,越來越多的國際組織與國家認可平行破產(chǎn),并通過立法推動不同破產(chǎn)程序間的協(xié)調(diào)與合作以實現(xiàn)跨國破產(chǎn)案件公平有效的審理。文章主要以聯(lián)合國國際貿(mào)易法委員會、歐盟、北美自由貿(mào)易區(qū)相關立法成果及其適用情況為主要研究對象,分析平行破產(chǎn)程序獲得立法確認的合理因素,研究平行破產(chǎn)程序間效力的協(xié)調(diào)以及相互之間有效合作的方式。在此基礎上,提出我國調(diào)整平行破產(chǎn)問題立法完善的建議與對策。
[Abstract]:From the current development of legislation and judicial practice of transnational bankruptcy law, more and more international organizations and countries recognize parallel bankruptcy, and promote coordination and cooperation among different insolvency procedures through legislation to achieve fair and effective trial of transnational bankruptcy cases. In this paper, the relevant legislative achievements and their application of UNCITRAL, EU and NAFTA are taken as the main research objects, and the reasonable factors for the legislative confirmation of parallel insolvency proceedings are analyzed. To study the coordination of effectiveness between parallel insolvency proceedings and the ways of effective cooperation between each other. On this basis, the suggestion and countermeasure of adjusting the legislation of parallel bankruptcy in our country are put forward.
