【摘要】：《聯(lián)合國(guó)反腐敗公約》(以下簡(jiǎn)稱為《公約》)作為聯(lián)合國(guó)史上第一部專門用來(lái)指導(dǎo)不同國(guó)家和地區(qū)反腐敗斗爭(zhēng)的法律文件,也是第一部專門用來(lái)明確規(guī)范和打擊腐敗活動(dòng)的國(guó)際公約�！豆s》在序言中就明確指出腐敗正成為一種影響國(guó)際社會(huì)穩(wěn)定和經(jīng)濟(jì)發(fā)展的跨國(guó)犯罪現(xiàn)象行為,因此為控制腐敗態(tài)勢(shì),必須加大國(guó)際合作力度,這同時(shí)也標(biāo)志著反腐敗斗爭(zhēng)正式走上了國(guó)際化道路�！豆s》認(rèn)為反腐敗的重點(diǎn)在于預(yù)防,因此公約通過(guò)給締約國(guó)設(shè)定法律義務(wù)、規(guī)定具體措施的方式構(gòu)建了較為系統(tǒng)的反腐敗預(yù)防體系,本文擬根據(jù)公約規(guī)定,并結(jié)合對(duì)代表性締約國(guó)履約實(shí)踐的分析,進(jìn)一步探討中國(guó)反腐敗預(yù)防機(jī)制的改革與完善。論文第一部分簡(jiǎn)要介紹了腐敗的含義及反腐敗預(yù)防機(jī)制的理論依據(jù)。論文第二部分對(duì)《公約》中的反腐敗預(yù)防機(jī)制進(jìn)行概述,包括反腐敗預(yù)防機(jī)制的具體規(guī)定及相應(yīng)分析。論文第三部分從具體實(shí)踐角度分析反腐敗預(yù)防機(jī)制,反腐敗預(yù)防機(jī)制既包括反腐敗預(yù)防機(jī)構(gòu)的建立完善,也包括具體的反腐敗預(yù)防保障制度,如公務(wù)員制度、反洗錢制度等。本章在介紹俄羅斯履行公約實(shí)踐過(guò)程中所構(gòu)建的反腐敗預(yù)防機(jī)制的基礎(chǔ)上,分析其經(jīng)驗(yàn)和教訓(xùn)以便為中國(guó)反腐敗預(yù)防實(shí)踐提供借鑒。論文第四部分論述中國(guó)目前預(yù)防腐敗機(jī)制現(xiàn)狀與相關(guān)法律的完善建議,從現(xiàn)行反腐敗預(yù)防實(shí)踐著手,評(píng)價(jià)分析其現(xiàn)存缺陷。具體包括外在層面的體制環(huán)境不完善、相關(guān)配套保障制度尚有欠缺和內(nèi)在層面的系統(tǒng)架構(gòu)、權(quán)力配置不均等問(wèn)題,同時(shí)針對(duì)所存在的缺陷提出完善建議,包括法律層面完善相關(guān)預(yù)防腐敗的立法規(guī)定,建構(gòu)反腐敗專門法和在系統(tǒng)論指導(dǎo)下完成相關(guān)專門預(yù)防腐敗機(jī)制構(gòu)建,并健全外部監(jiān)督機(jī)制,加強(qiáng)國(guó)際合作交流。反腐敗是一個(gè)與時(shí)俱進(jìn)的研究課題,我們?cè)诜锤瘮☆A(yù)防實(shí)踐中,一定要將預(yù)防戰(zhàn)略提升至全局化高度,與國(guó)際接軌。在此基礎(chǔ)上,實(shí)施廣泛的社會(huì)參與作為預(yù)防腐敗的綜合治理措施之一,實(shí)現(xiàn)懲治預(yù)防并舉,建立完善具有中國(guó)特色的反腐敗預(yù)防機(jī)制。
[Abstract]:The United Nations Convention against Corruption (hereinafter referred to as the Convention) is the first legal document in the history of the United Nations dedicated to guiding the fight against corruption in different countries and regions, It is also the first international convention devoted to the explicit regulation and combating of corruption, which, in its preamble, clearly states that corruption is becoming a transnational criminal phenomenon affecting the stability and economic development of the international community, Therefore, in order to control the situation of corruption, it is necessary to strengthen international cooperation, which at the same time marks that the fight against corruption is officially on the path of internationalization. The Convention considers that the focus of the fight against corruption is on prevention, and thus establishes legal obligations on States parties through the Convention, According to the provisions of the Convention and the analysis of the implementation practice of representative States parties, this paper further discusses the reform and perfection of anti-corruption prevention mechanism in China. The first part briefly introduces the meaning of corruption and the theoretical basis of anti-corruption prevention mechanism. The second part of the paper summarizes the anti-corruption prevention mechanism in the Convention, including the specific provisions of the anti-corruption prevention mechanism and the corresponding analysis. The third part of the paper analyzes the anti-corruption prevention mechanism from the perspective of specific practice. The anti-corruption prevention mechanism includes not only the establishment and perfection of anti-corruption prevention institutions, but also the specific anti-corruption prevention safeguard system, such as civil servant system, anti-money-laundering system and so on. Based on the introduction of the anti-corruption prevention mechanism constructed in Russia's implementation of the Convention, this chapter analyzes its experiences and lessons in order to provide reference for China's anti-corruption prevention practice. The fourth part of the paper discusses the current situation of the mechanism of corruption prevention in China and some suggestions on how to improve the relevant laws. From the current practice of anti-corruption prevention, the author evaluates and analyzes its existing defects. Including the external level of the institutional environment is not perfect, the relevant supporting security system is still lacking and the internal level of the system framework, power allocation is not equal, and at the same time to improve the shortcomings of the recommendations, It includes perfecting the relevant legislative provisions on the prevention of corruption at the legal level, constructing the special anti-corruption law and completing the construction of the relevant special corruption prevention mechanism under the guidance of the system theory, perfecting the external supervision mechanism, and strengthening the international cooperation and exchange. Anti-corruption is a research subject that keeps pace with the times. In the practice of anti-corruption prevention, we must promote the prevention strategy to the global level and connect with the international standards. On this basis, the implementation of extensive social participation as one of the comprehensive measures to prevent corruption, the implementation of both punishment and prevention, the establishment and improvement of anti-corruption prevention mechanism with Chinese characteristics.
