我國深海礦業(yè)融資渠道的法律探究——以深海礦產(chǎn)利益共同性為視域

【摘要】:以深海礦產(chǎn)利益共同性中的國家利益、外國利益,以及國內(nèi)私有利益為視域,明確我國深海礦業(yè)融資渠道的理論構(gòu)成為政府資本財政投資渠道、外國資本外商直接投資渠道和國內(nèi)社會資本商業(yè)化融資渠道,正視我國立法因缺乏對"利益共同性"之關(guān)注所引起的渠道阻滯的法律原因,理性論證引導(dǎo)政府資本財政投資渠道高效轉(zhuǎn)化投資成果,合理規(guī)制外國資本外商直接投資獨資化趨勢,增強(qiáng)國內(nèi)社會資本商業(yè)化融資渠道競爭力三大機(jī)制的完善空間。在順應(yīng)國家供給側(cè)結(jié)構(gòu)性改革的浪潮中,發(fā)揮我國引領(lǐng)其他發(fā)展中國家共同開發(fā)國際海底資源的積極作用。
[Abstract]:From the perspective of national interest, foreign interest and domestic private interest in the commonality of deep-sea mineral interests, it is clear that the theoretical structure of deep-sea mining financing channel in China is government capital financial investment channel. Foreign capital foreign direct investment channels and domestic social capital commercial financing channels, facing up to the lack of our legislation due to the lack of attention to the "common interests" caused by the channel block legal reasons, Rational demonstration guides the government capital financial investment channel to transform the investment achievement efficiently, reasonably regulates the foreign capital foreign direct investment sole proprietorship tendency, strengthens the domestic social capital commercialization financing channel competition ability three big mechanism consummation space. In compliance with the wave of supply-side structural reform, China is playing an active role in leading other developing countries to jointly develop international seabed resources.
