【摘要】：管控國際海事安全風(fēng)險的法律途徑主要包括國家單邊海事制度、國際海事條約和區(qū)域性海事制度安排。海上運輸?shù)目鐓^(qū)域性、海事風(fēng)險的互通性和海事權(quán)益的全球性,使得管控國際海事安全風(fēng)險的法律途徑在具體實施過程中存在一定沖突,在相當(dāng)程度上減弱了這些法律預(yù)設(shè)的效果。解決國際海事安全法律沖突的較優(yōu)路徑是構(gòu)建協(xié)同性強的區(qū)域性海事制度安排。在解決國際海事安全法律體系構(gòu)成的內(nèi)在自洽性基礎(chǔ)上,需要進(jìn)一步完善相關(guān)的國際海事安全法律制度,包括限縮國際海事安全管控事項、構(gòu)建船舶檢查制度、健全海事生態(tài)保護應(yīng)急制度和完善船員安全法律制度。只有通過外部的沖突協(xié)調(diào)和內(nèi)部的制度完善,才能共同構(gòu)建通暢安全高效的海上運輸通道。
[Abstract]:The legal ways to control the risk of international maritime security mainly include unilateral maritime regime, international maritime treaty and regional maritime system arrangement. The trans-regional maritime transport, the interoperability of maritime risks and the global maritime rights and interests make the legal ways to control the international maritime security risks conflict in the concrete implementation process. To a considerable extent, these legal presuppositions are weakened. The best way to solve the conflict of international maritime security law is to construct regional maritime system arrangement with strong cooperation. On the basis of solving the inherent self-consistency of the international maritime safety legal system, it is necessary to further improve the relevant international maritime safety legal system, including the reduction of international maritime safety control and control, and the construction of ship inspection system. Improve the maritime ecological protection emergency system and improve the crew safety legal system. Only through the external conflict coordination and the internal system perfection, can the smooth, safe and efficient maritime transportation channel be built together.
