【摘要】：近半世紀的國際交往實踐中,一系列旨在建立國際經(jīng)濟新秩序的決議通過聯(lián)合國大會被通過,但是此類決議的法律效力和法律性質(zhì)是眾說紛紜、沒有同一定論。眾所周知,聯(lián)合國大會是建立國際經(jīng)濟新秩序、維護世界平和的重要工具,探討聯(lián)合國大會大所作決議的國際法律效力對當(dāng)今世界范圍內(nèi)國際經(jīng)濟新秩序的建立和維護世界和平具有重要的現(xiàn)實意義。而本文通過探討聯(lián)合國大會決議具有法律效力的深層原因即從法理角度、法律效力的判斷標準、影響因素等三個方面分析,并結(jié)合科索沃戰(zhàn)爭、利比亞戰(zhàn)爭中聯(lián)合國決議的執(zhí)行情況,來對聯(lián)合國大決議的法律效力問題做出說明,以期對聯(lián)合國決議的國際法效力問題給出一個合理答案。
[Abstract]:In the practice of international communication for nearly half a century, a series of resolutions aimed at establishing a new international economic order have been adopted by the General Assembly of the United Nations. As we all know, the General Assembly of the United Nations is an important instrument for the establishment of a new international economic order and for the maintenance of world peace, It is of great practical significance for the establishment of a new international economic order in the world and the maintenance of world peace to explore the international legal effect of the resolutions made by the United Nations General Assembly. In this paper, the deep reasons why the UN General Assembly resolutions have legal effect are analyzed from the angle of legal theory, the judgment standard of legal effect, the influencing factors, and combined with the Kosovo War. The implementation of the United Nations resolutions in the Libyan War is intended to explain the legal effect of the United Nations resolutions in order to give a reasonable answer to the legal effects of the United Nations resolutions.
