文化貿(mào)易自由化和文化多樣性的國際法律沖突與協(xié)調(diào)

【摘要】:當(dāng)今社會,文化貿(mào)易已經(jīng)成為一個國家對外貿(mào)易的重要組成部分。WTO自由貿(mào)易體制的發(fā)展,一方面極大的促進了各國間包括文化在內(nèi)的貿(mào)易往來,各國家和地區(qū)文化的快速流動,繁榮了全球文化市場,而且?guī)恿伺c文化產(chǎn)業(yè)相關(guān)的其他產(chǎn)業(yè)的發(fā)展。但另一方面,文化貿(mào)易的過度自由又造成了貿(mào)易失衡的,文化產(chǎn)品和文化服務(wù)單向的從發(fā)達國家流向不發(fā)達的國家和地區(qū),使得文化輸入國在被迫接受外來文化的同時,失去對其本國文化的認同感。文化強國借文化貿(mào)易的方式在推行自己的價值觀念和意識形態(tài),在文化上形成霸權(quán)主義。 2005年聯(lián)合國教科文組織(UNESCO)頒布的《保護和促進文化表現(xiàn)形式多樣性公約》(以下簡稱《公約》),意味著國際社會對文化多樣性的尊重與保護,《公約》的出臺把對文化多樣性的保護上升到國際法層面,為各國采取措施保護文化多樣性提供了理論上的依據(jù)和法律支撐。但是《公約》中的規(guī)定,在一定程度上與WTO貿(mào)易自由體系存在沖突,公約中賦予締約方文化主權(quán)和為保護本國文化多樣性而采取政策措施的權(quán)利,這是與WTO的原則相違背的。如何化解和協(xié)調(diào)文化貿(mào)易自由化和文化多樣性的國際法律沖突,促進國際文化貿(mào)易的健康發(fā)展成了目前法學(xué)界最為關(guān)心的問題。 在此背景下,本論文分析了WTO中文化貿(mào)易的條款,通過對公約的制定和實施過程的來龍去脈進行闡述,找出二者相沖突之處,并針對這些沖突提出調(diào)和的解決方式,最后為我國找出促進自身發(fā)展的同時又能協(xié)調(diào)沖突的對策建議。 論文的第一部分闡述了選題背景和意義;第二部分闡明了文化貿(mào)易自由化和文化多樣性的國際立法;第三部分是關(guān)于文化貿(mào)易自由化和文化多樣性在UNESCO和WTO下的法律沖突;第四部分就文化貿(mào)易自由化和文化多樣性法律沖突的協(xié)調(diào)進行了論述;論文的第五部分則分析了我國現(xiàn)行協(xié)調(diào)沖突的法律規(guī)制現(xiàn)狀和存在的不足,提出了完善我國協(xié)調(diào)沖突的法律對策的思考。 本文的最終結(jié)論是:并不反對貿(mào)易自由化,但主張在文化貿(mào)易自由化的過程中對文化多樣性保護給予適當(dāng)?shù)年P(guān)注。對國際公約間沖突的協(xié)調(diào)應(yīng)該要以發(fā)展的眼光來對待,為此,我國應(yīng)充分利用國際公約的相關(guān)規(guī)定,結(jié)合自身實際情況,放眼國際法律實踐,在加強協(xié)調(diào)沖突的國內(nèi)立法建設(shè)的同時,要采取靈活的文化貿(mào)易法律策略,通過文化產(chǎn)業(yè)與文化貿(mào)易法律對策的不斷發(fā)展與運用,促進我國文化競爭力的提高,進而為世界和諧做出貢獻。
[Abstract]:In today's society, cultural trade has become an important part of a country's foreign trade. The development of the WTO free trade system, on the one hand, has greatly promoted the exchange of trade among countries, including culture, and the rapid flow of culture in all countries and regions. It has prospered the global cultural market and led to the development of other industries related to the cultural industry. But on the other hand, the excessive freedom of cultural trade has resulted in trade imbalance. Cultural products and cultural services flow one-way from developed countries to underdeveloped countries and regions, making cultural importing countries forced to accept foreign cultures at the same time. Lose one's sense of identity with one's own culture. Cultural power promotes its own values and ideology by the way of cultural trade and forms hegemonism in culture. The Convention on the Protection and Promotion of the Diversity of Cultural expressions (hereinafter referred to as the Convention) promulgated by UNESCO in 2005 means that the international community respects and protects cultural diversity. The protection of diversity has risen to the level of international law, It provides theoretical basis and legal support for countries to take measures to protect cultural diversity. However, the provisions in the Convention, to some extent, conflict with the WTO free trade system. The treaty gives the parties the cultural sovereignty and the right to take policy measures to protect their cultural diversity, which is contrary to the principle of WTO. How to resolve and coordinate the international legal conflicts between cultural trade liberalization and cultural diversity and promote the healthy development of international cultural trade has become the most concerned issue in the field of law. In this context, this paper analyzes the terms of cultural trade in WTO, through the formulation and implementation of the Convention to explain the process of development and implementation, to find out the conflict between the two, and to these conflicts proposed to reconcile the solution. Finally, we find out the countermeasures and suggestions to promote our own development and coordinate the conflict at the same time. The first part of the thesis expounds the background and significance of the topic, the second part expounds the international legislation of cultural trade liberalization and cultural diversity, the third part is about the conflict of laws between cultural trade liberalization and cultural diversity under UNESCO and WTO. The fourth part discusses the legal conflict of cultural trade liberalization and cultural diversity, the fifth part of the paper analyzes the current situation and shortcomings of the legal regulation of the coordination conflict in China. This paper puts forward the legal countermeasures to perfect the coordination conflict in our country. The final conclusion of this paper is that it is not opposed to trade liberalization, but it advocates that due attention should be paid to the protection of cultural diversity in the process of cultural trade liberalization. The coordination of conflicts between international conventions should be treated from the perspective of development. Therefore, our country should make full use of the relevant provisions of international conventions, combine with our own actual situation, and look at international legal practice. While strengthening the construction of domestic legislation to coordinate the conflict, we should adopt flexible legal strategies of cultural trade and promote the improvement of our country's cultural competitiveness through the continuous development and application of cultural industry and cultural trade legal countermeasures. And then contribute to the harmony of the world.
