國(guó)際環(huán)境法的主體研究

【摘要】:國(guó)際環(huán)境法作為一個(gè)獨(dú)立的法律部門,其主體與傳統(tǒng)的國(guó)際法主體有所不同。由于國(guó)際環(huán)境法是一門綜合性、邊緣性法律學(xué)科,最為重要的是當(dāng)代國(guó)際環(huán)境問(wèn)題的特殊性,僅以國(guó)家、國(guó)際組織者作為國(guó)際環(huán)境法的主體,顯然已不能適應(yīng)形勢(shì)的需要,無(wú)法調(diào)整、規(guī)范復(fù)雜的國(guó)際環(huán)境關(guān)系。本文主要通過(guò)比較研究方法、文獻(xiàn)研究方法和歷史研究方法論述了國(guó)際環(huán)境法的相關(guān)理論,對(duì)國(guó)際環(huán)境法的主體中尚存爭(zhēng)議的國(guó)際環(huán)境非政府組織、跨國(guó)公司的主體地位的可行性進(jìn)行論證。 研究的主要方面是國(guó)際環(huán)境非政府組織和跨國(guó)公司是否成為國(guó)家環(huán)境法的主體。這個(gè)問(wèn)題本身就是國(guó)際法學(xué)界一個(gè)爭(zhēng)議的熱點(diǎn)問(wèn)題,并且也是一個(gè)非,F(xiàn)實(shí)的問(wèn)題,如何將越來(lái)越多非政府組織和跨國(guó)公司的資源整合在一起,承擔(dān)起全球環(huán)境治理的重任,使其在良性氛圍下運(yùn)作,是本文討論的一個(gè)重點(diǎn)。國(guó)際環(huán)境法的立法本質(zhì)需要多元主體參與的治理,國(guó)際環(huán)境法最后得以保障實(shí)施也是多元主體追求公共利益,形成良性互動(dòng)的和諧關(guān)系的過(guò)程。全世界國(guó)際法學(xué)者,應(yīng)該看到傳統(tǒng)國(guó)際法理論在環(huán)境保護(hù)領(lǐng)域的不足,應(yīng)把國(guó)際環(huán)境法這門科學(xué)的體系逐漸完備起來(lái),一些重要的理論諸如主體理論已經(jīng)不適用環(huán)境保護(hù)的需要,亟待完善。 基于以上分析,針對(duì)討論的國(guó)際環(huán)境法的主體,提出自己的觀點(diǎn):國(guó)際環(huán)境法的主體應(yīng)該有所調(diào)整,順應(yīng)時(shí)代的發(fā)展。筆者更贊同國(guó)際環(huán)境非政府組織的主體地位理論之爭(zhēng)的有限肯定說(shuō),認(rèn)為國(guó)際法主體是不斷發(fā)展的理念,一個(gè)開放的概念。在一定條件和有限范圍內(nèi)承認(rèn)某些國(guó)際環(huán)境非政府組織的國(guó)際環(huán)境法的主體地位。贊同跨國(guó)公司的主體地位理論之爭(zhēng)的肯定論,認(rèn)為通過(guò)用立法逐漸導(dǎo)向跨國(guó)公司的行為,將其在全球環(huán)境保護(hù)做出的貢獻(xiàn)給予法律上的認(rèn)可,對(duì)于破壞環(huán)境的跨國(guó)公司給予懲罰。 國(guó)際環(huán)境法最明顯的不同在于其更加注重行為主體的多元化和多樣性,也就是說(shuō),由原來(lái)的“國(guó)家中心主義論”逐漸向“多中心論”發(fā)展,各種非國(guó)家行為主體在不同層次之問(wèn)互相合作,互相聯(lián)系在全球環(huán)境問(wèn)題上發(fā)揮作用。
[Abstract]:As an independent legal department , the international environmental law is different from the traditional subject of international law . As the international environmental law is a comprehensive and marginalized legal subject , the most important is the particularity of contemporary international environmental problems . It is obviously unable to adapt to the needs of the situation and to regulate the complex international environmental relations . This paper mainly discusses the relevant theories of international environmental law through comparative research methods , literature research methods and historical research methods , and demonstrates the feasibility of the main status of international environmental non - governmental organizations and transnational corporations in the subject of international environmental law .
The main aspects of the study are whether international environmental non - governmental organizations and transnational corporations become the main body of national environmental law . The problem is itself a hot topic in the international law field and a very realistic problem . How to integrate more and more non - governmental organizations and transnational corporations is a key point of this paper .
Based on the above analysis , in view of the subject of the international environmental law , the author puts forward its own view that the subject of international environmental law should be adjusted to the development of the times . The author also agrees that the subject of international environmental law is the subject status of the international environmental law of non - governmental organizations in international environment .
The most obvious difference between international environmental law is that it pays more attention to the diversity and diversity of the actor , that is , from the original theory of " state centralism " to " multi - center theory " , various non - State actors ask each other at different levels , and each other plays a role in the global environmental problem .
